Committee Chair Hellewell called the meeting to order at 8:05 a.m.

MOTION: Sen. Hickman moved to approved the minutes of the Jan. 20, 2006 meeting.

The motion passed unanimously with Sen. Davis and Sen. Hale absent for the vote.

1.    S.B. 0113 Governmental Immunity Limits (H. Stephenson)

    Stephenson explained the purpose of the bill.

    The following individuals spoke in opposition to the bill:
             Jodi Hoffman, Utah League of Cities & Towns
            Karl Hendrickson, Utah Assn. of Counties
            Steven H. Peterson, Utah School Board Assn.
            Dean Steel, Utah Risk Management



    Lorene Miller spoke in favor of the bill.

     MOTION: Sen. Davis moved to go to the next item on the agenda.

    The motion passed unanimously.

2.    S.B. 0132 Surplus Property Amendments (P. Knudson)

    Sen. Knudson explained the bill provides for the sale of personal handheld electronic devices to certain users upon a change in employment status.

     MOTION: Sen. Hickman moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Davis being absent for the vote.

3.    S.B. 0127 Vacating or Changing a Subdivision Plat (P. Knudson)

    Sen. Knudson explained that the bill modifies county and municipal provisions relating to land use and development.
    
    Nicole Cline, Tooele County Planning Commission, spoke in support of the bill.

    Richard Maughan, Davis County Recorder, spoke of concerns he had with the bill if it passes the way it is written.

     MOTION: Sen. Hickman moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Davis being absent for the vote.

4.    H.B. 0029 Township Amendments (L. Christensen)

    Rep. Christensen explained that the bill modifies the criteria that an unincorporated area is required to meet in order to be designated as a township.

     MOTION: Sen. Hale moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Davis being absent for the vote.




5.    H.B. 0043 Sunset Review and Reauthorization (J. Alexander)

    Rep. Alexander explained the bill.

    Tony Patterson, Attorney General's Office, spoke in opposition to the bill, specifically to the repeal date of the Motor Fuel Marketing Act.

    The following individuals spoke in support of the bill:

        Roylayne Fairclough, AAA Utah
        Gary Thorpe, Utah Petroelum
        Brad Randall, Randall Distributing
        
     MOTION: Sen. Christensen moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Davis being absent for the vote.

6.    H.J.R. 003 Joint Rules Resolution - Base Budget Process (R. Bigelow)

    Rep. Bigelow explained the bill and the amendments made to the bill on the House Floor.

     MOTION: Sen. Hale moved to pass the bill out favorably.

    The motion passed with Sen. Hickman voting in opposition to the bill and with
    Sen. Davis being absent for the vote.

     MOTION: Sen. Hale moved to adjourn.

    The motion passed unanimously.

    Committee Chair Hellewell adjourned the meeting at 9:45 a.m.
