Committee Chair Hellewell called the meeting to order at 8:05 a.m.

1.    S.B. 0079 Uniform Debt-Management Services Act (L. Hillyard)

    Sen. Hillyard explained the bill.

    Thad LeVar, Utah Division of Consumer Protection, answered questions posed by the committee. Mr. LeVar spoke in favor of the bill.

     MOTION: Sen. Hickman moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Hale absent for the vote.

2.    S.B. 0190 Shared Government Records Amendments (M. Dmitrich)

    Sen. Dmitrich explained that the bill initiated with the Legislative Audit Committee. He asked the committee to adopt the following amendment to the bill:

1.    Page 1, Lines 18 through 20 :    

             18          .    provides that a
{   person may not submit a request for a record to a   } governmental

             19      entity that has received
{   the   }        a       record as a shared record from another governmental

     entity for enforcing, litigating, or investigating the law or for auditing purposes
  may not provide the record;

    .    provides that if a governmental entity is prohibited from providing certain records, it shall deny the records request and inform the person making the request that records requests must be submitted to the governmental entity that prepares, owns, or retains the record; and
    .     make technical changes

2.    Page 2, Lines 38 through 45 :    

             38          (2) (a) Subject to Subsection (2)(b), a person making a request for a record shall submit
             39      the request to the governmental entity that prepares, owns, or retains the record.
             40          (b)
{   A person may not submit a request for a record to a governmental entity that has

             41      received the record  
}
  In response to a request for a record, a governmental entity may not provide a record that it has received       under Section 63-2-206 as a shared record        if the record was shared       for the purpose of:

             42          (i) enforcing, litigating, or investigating civil, criminal, or administrative law; or
             43          (ii) auditing, if the governmental entity is authorized by state statute to conduct an
             44      audit.
 

    (c)    If a governmental entity is prohibited from providing a record under Subsection (2)(b), it shall:
        (i)    deny the records request; and
        (ii)    inform the person making the request that records requests must be submitted to the governmental entity that prepares, owns, or retains the record.  

             45          [(2)]
{   (c)   }        (d)       A governmental entity may make rules in accordance with Title 63, Chapter


     MOTION: Sen. Davis moved to adopt the amendment to the bill.

    The motion passed unanimously with Sen. Hale absent for the vote.

    Auditor General John Schaff spoke in support of the bill as amended.


     MOTION: Sen. Davis moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Hale absent for the vote.
    
3.     S.C.R. 003 Concurrent Resolution Honoring America's Military War Dogs
     (E. Mayne)

    Sen. Mayne explained the bill.

    Randy Knight, Adjutant, The American Legion, spoke in support of the bill.

     MOTION: Sen. Davis moved to pass the bill out favorably.

    The motion passed unanimously.

     MOTION: Sen. Hale moved to place the bill on the Consent Calendar.

    The motion pass unanimously.

4.    H.B. 0013 Common Polling Places Amendments (D. Aagard)

    Rep. Aagard proposed the following amendment:

1.    Page 2, Lines 42 through 47 :    

             42          (2) (a) The county legislative body shall alter or divide voting precincts so that each
             43      voting precinct contains not more than [1,000]
{   2,000   }        1,250       active voters.

             44          (b) The county legislative body shall:
             45          (i) identify those precincts that may reach [1,000]
{   2,000 active voters or become   }        the limit of active voters in a precinct under Subsection (2)(a) or that becomes       too

             46      large to facilitate the election process; and
             47          (ii) divide those precincts before February 1.

    MOTION: Sen. Hickman moved to adopt the amendment to the bill.

    The motion passed with Sen. Hale absent for the vote.

    Rep. Aagard explained the bill as amended.



    Lt. Governor Gary R. Herbert spoke in support of the amended bill.

     MOTION: Sen. Christensen moved to pass the bill out favorably as amended.

    The motion passed unanimously with Sen. Hale absent for the vote.

5.    H.B. 0015 Early Voting (D. Aagard)

    Rep. Aagard explained the bill amends the Election Code to permit in-person early voting prior to the date of the election.     

    Lt. Governor Gary R. Herbert spoke in support of the bill.

     MOTION: Sen. Hickman moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Hale absent for the vote.

6.    H.B. 0067 Military and Overseas Citizens Absentee Voter Amendments
     (S. Urquhart)

    Rep. Urquhart explained the bill modifies the Election Code by amending provisions for registration and voting by certain military and overseas citizen voters.

    Lt. Governor Gary R. Herbert spoke in support of the bill.

     MOTION: Sen. Hickman moved to pass the bill out favorably.

    The motion passed unanimously.

7.    H.B. 0205 Repeal of Obsolete Dependent Special Districts (Julie Fisher)

    Rep. Fisher explained the bill repeals provisions relating to dependent special districts.

     MOTION: Sen. Christensen moved to pass the bill out favorably.

    The motion passed unanimously.

     MOTION: Sen. Hale moved to place the bill on the Consent Calendar.

    The motion passed unanimously.



     MOTION: Sen. Christensen moved to adjourn.

    Committee Chair Hellewell adjourned the meeting at 8:50 a.m.
