Committee Chair Hellewell called the meeting to order at 8:08 a.m.

MOTION: Sen. Hickman moved to approve the minutes of the February 14, 2006, meeting.

The motion passed unanimously with Sen. Christensen and Sen. Davis absent for the vote.

1.    H.J.R. 008 Resolution Revising Executive Officer Succession Provisions (S. Allen)

    Rep. Allen explained the bill with the assistance of Roger Tew, Constitutional Revision Commission. Mr. Tew spoke in support of the bill.

    Judge Jon Memmott, Davis County Courts, spoke in support of the bill.

     MOTION: Sen. Hale moved to pass the bill out favorably.

    The motion failed with Sen. Hellewell and Sen. Hickman voting in opposition, and with Sen. Davis absent for the vote.

     MOTION: Sen. Hellewell moved to reconsider the previous action.

    The motion passed unanimously with Sen. Davis absent for the vote.



     MOTION: Sen. Hickman moved to amend the bill as follows:

    1. Page 2, Line 28:            After "Senate" delete "and House of Representatives"

    2. Page 3, Line 85:            After "consent of" delete "both"

                        After "Senate" delete "and the House of
                        
                        Representatives
"
    
    The motion passed with Sen. Hale voting in opposition to the amendment, and with
    Sen. Davis absent for the vote.

     MOTION: Sen. Hale moved to pass the bill out favorably as amended.
    
    
The motion passed unanimously with Sen. Davis absent for the vote.

2.    H.B. 0028S1 Access and Fee Amendments to Government Records Access and
    Management Act
(D. Aagard)

    Rep. Aagard proposed the committee adopt H.B. 0028 1st substitute.

     MOTION: Sen. Hickman moved to adopt the substitute bill.

    The motion passed unanimously with Sen. Davis absent for the vote.

    Rep. Aagard explained the substitute bill.

    Michael O'Brien, attorney, Utah Media Coalition, said the Coalition has no objections to the substitute bill.
    
    Shelly Tuescher-Cordon, Lexus Nexus, spoke in support of the bill.

     MOTION: Sen. Hickman proposed the following amendment:
    
    1. Page 4, Line 105:    After "program" insert "not currently maintained by the governmental entity"

    The motion passed unanimously with Sen. Davis absent for the vote.


     MOTION: Sen. Christensen moved to pass the substitute bill out favorably as amended.

    The motion passed unanimously with Sen. Hickman absent for the vote.

3.    H.B. 0012 Amendments to Government Records Access and Management Act     (D. Aagard)

    Rep. Aagard explained the bill.

    Michael O'Brien, Utah Media Coalition, spoke in opposition to the bill.

     MOTION: Sen. Hickman moved to pass the bill out favorably.

    The motion passed with Sen. Davis and Sen. Hale voting in opposition.

4.    H.B. 0076 High Deductible Health Plan Option for Public Employees
    (B. Daw)

    Rep. Daw explained the bill.

    Kelly Atkinson, Executive Director, Utah Health Insurance Assn., spoke to the bill.

    Linn Baker, Director, Public Employees Health Plan, spoke in support of the bill.

     MOTION: Sen. Hickman moved to pass the bill out favorably.

     SUBSTITUTE MOTION: Sen. Davis moved the following amendment:

    Page 2 line 48, (c) change "shall" to "may"

    Mr. Baker spoke in opposition to the amendment.

    The substitute motion failed with Sen. Hellewell, Sen. Christensen, and Sen. Hickman voting in opposition.

    The original motion passed with Sen. Davis and Sen Hale voting in opposition.

5.    H.B. 0461 Veterans Nursing Home - Extension Bond Authorization (A. Hardy)

    Rep. Hardy explained the bill.



    William Christofferson, National Veteran's Assn., spoke in support of the bill.
                    
     MOTION: Sen. Christensen moved to pass the bill out favorably.

    The motion passed unanimously.

6.    H.J.R. 010 Joint Rules Resolution - Disclosure of Conflict of Interest (R. Romero)

    Rep. Romero explained the bill.

     MOTION: Sen. Davis moved to pass the bill out favorably.

    The motion passed with Sen. Hellewell and Sen. Hickman voting in opposition.

     MOTION: Sen. Davis moved to adjourn.

    The motion failed.

7.    H.B. 0269 Human Resource Management Amendments (D. Clark)

    Rep. Clark explained the bill.

     MOTION: Sen. Hickman moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Davis and Sen. Hale absent for the vote.

Sen. Christensen moved to adjourn.

Sen. Hellewell moved to adjourn the meeting at 9:35 a.m.
