Committee Chair Christensen called the meeting to order at 2:10 p.m.

1.    H.B. 0222 Unborn Child Pain Prevention Act (P. Ray)

    Rep. Ray explained the bill.

    The following persons spoke in opposition to the bill:
        Marla Shelby Jrabner, CEO, Allen Memorial Hospital
        Katherine Wheeler, Pres., Utah Medical Assn.
        Dave Turak, OBGYN Physician
        Dr. Cynthia Jones, American Assn.of Gynecologists
        Carrie Galaway, director, Planned Parenthood

    Gayle Ruzika, Eagle Forum spoke in support of the bill.

     MOTION: Sen. Knudson moved to go to the next item on the agenda.

     SUBSTITUTE MOTION: Sen. Bell moved to pass the bill out favorably.


    The motion failed with Sen. Goodfellow, Sen. Knudson, and Sen. McCoy voting against the motion.

    The original motion failed with Sen. Christensen, Sen. Bell, and Sen. Valentine voting against the motion.

    Pres. Valentine suggested that the sponsor bring the bill back to the committee with amendments.

     MOTION: Pres. Valentine moved to go to the next item on the agenda.

    The motion passed with Sen. Christensen voting against the motion.

2.    S.B. 160 Physician Licensing Amendments (B. Evans)

    Sen. Evans proposed the following amendment to the bill:

1.    Page 4, Lines 93 through 96 :    

             93          (b) the applicant
{   documents   }        submits a written document to the division from a health care facility licensed under Title 26, Chapter21, Health Care Facility Licensing and Inspection Act, stating       that the applicant is practicing under the invitation of      {   a

             94      sponsoring entity;  
}
  the health care facility;      

             95          (c) the applicant submits a
{   verification   }        signed certification to the division       that the applicant meets the requirements of

             96      Subsection (2);

2.    Page 4, Line 103 :    

             103      by endorsement is denied.
 

    (4) The division shall issue a temporary license under Subsection (3) within 15 business days after the applicant satisfies the requirements of Subsection (3).  

    
     MOTION: Sen. Bell moved to adopt the amendment.

    The motion passed with Sen. Knudson and Pres. Valentine absent for the vote.

    Sen. Evans explained that the bill amends the licensure by endorsement provisions of the Utah Medical Practices Act.

    Laura Poe, Division of Occupational and Professional Licensing, and David Gessell, Utah Hospital Association, spoke in support of the bill.



     MOTION: Sen. Bell moved to pass the bill out favorably as amended.

    The motion passed with Sen. Knudson and Pres. Valentine absent for the vote.

3.    S.B. 0213 Clarifications to Guardian Ad Litem (D. Eastman)

    Sen. Eastman asked that the bill be amended as follows:

1.    Page 6, Line 182 through Page 7, Line 186 :    

             182          (3)
{   The   }        In civil cases in the district court, the       attorney guardian ad litem [shall be appointed in accordance with and meet the

             183      requirements of Sections 78-3a-911 and 78-3a-912 .] appointed under the provisions of this
             184      section shall:
             185          (a) represent the best interests of the child from the date of the appointment until
             186      released by the court;
    
     MOTION: Sen. Bell moved to adopt the amendment.

    The motion passed unanimously with Pres. Valentine absent for the vote.

    Sen. Eastman explained the bill makes changes to the Guardian Ad Litem statute in response to a legislative audit.
         
    Kristin Brewer, director, Office of the Guardian ad Litem and Keith Kelly, Guardian ad Litem Oversight Committee spoke in favor of the bill.
    
     MOTION: Sen. Goodfellow moved to pass the bill out favorably as amended.

    The motion passed unanimously with Pres. Valentine absent for the vote.

     MOTION: Sen. McCoy moved to adjourn.

Sen. Christensen adjourned the meeting at 3:55 p.m.
