Committee Chair Waddoups called the meeting to order at 8:03 a.m.
1. Approval of Minutes
MOTION: Sen. Peterson moved to approve the minutes of February 17, 2006.
The motion passed unanimously with Sen. Evans and Sen. Hatch absent at the time of voting.
2. S.B. 241 Natural Resources Development (Sen. M. Dmitrich)
Sen. Mike Dmitrich introduced the bill. Spencer Stokes, Baard Energy, assisted in the presentation.
MOTION: Sen. Peterson moved to replace S.B. 241 with 1st Substitute S.B. 241.
The motion passed unanimously with Sen. Evans and Sen. Hatch absent at the time of voting.
MOTION: Sen. Peterson moved to pass 1st Substitute S.B. 241, Natural Resources Development, out favorably.
The motion passed unanimously with Sen. Evans absent at the time of voting.
Sen. Peterson assumed the committee chair.
3. 1st Sub. H.B. 100 Environmental Litigation Bond (Rep. A. Tilton)
Rep. Aaron Tilton introduced the bill.
David Creer, Executive Director, Utah Trucking Association; Mike Peterson, Executive Director, Utah Rural Electrical Association; and Rich Thorn, CEO, Association of General Contractors, spoke in support of the bill.
Kathy Van Dame, League of Women Voters; Jonathan Tichy, Attorney; and Steven Bloch, Attorney, Southern Utah Wilderness Association, spoke in opposition to the bill.
Dianne Nielson, Executive Director, Dept. of Environmental Quality, spoke to the bill.
Sen. Waddoups assumed the committee chair.
MOTION: Sen. Peterson moved to pass 1st Sub. H.B. 100, Environmental Litigation Bond , out favorably.
SUBSTITUTE MOTION: Sen. Fife moved to send the bill to Interim Study.
The substitute motion failed with Sen. Fife and Sen. McCoy voting in support and Sen. Evans,
Sen. Hatch, Sen. Peterson and Sen. Waddoups voting in opposition.
The original motion passed with Sen. Fife and Sen. McCoy voting in opposition.
4. 1st Sub. H.B. 47 Sales Tax Diversion for Water Projects and Water Financing (Rep. D. Ure)
Rep. David Ure introduced the bill.
Erin Neyrey, River Defense Coordinator, Utah Rivers Council, spoke in opposition to the bill.
MOTION: Sen. Hatch moved to pass 1st Sub. H.B. 47, Sales Tax Diversion for Water Projects and Water Financing, out favorably.
The motion passed with Sen. Fife and Sen. McCoy voting in opposition.
MOTION: Sen. McCoy moved to adjourn.
The motion passed unanimously.
Chair Waddoups adjourned the meeting at 9:04 a.m.
