9 General Description:
10 This concurrent resolution of the Legislature and the Governor approves the
11 construction of the new transportation maintenance shed near Meadow, Utah.
12 Highlighted Provisions:
13 This resolution:
14 . approves the construction of the new transportation maintenance shed near
15 Meadow, Utah.

19 Be it resolved by the Legislature of the state of Utah, the Governor concurring therein:
20 WHEREAS, the Utah Code requires state agencies to obtain legislative approval for
21 construction of any new facility that costs over $250,000 to construct;
22 WHEREAS, the Utah Code does not require legislative approval for construction of a
23 new facility when the new facility is built for "the replacement of state-owned space that is
24 demolished, if the total construction cost of the replacement space is less than $1,500,000";
25 WHEREAS, the Utah Department of Transportation constructed a new transportation
26 maintenance shed near Meadow, Utah to replace its existing transportation maintenance shed
27 for a cost of $731,000 with the intent of demolishing the existing transportation maintenance
28 shed;
29 WHEREAS, because the Utah Department of Transportation intended to demolish the
30 existing transportation maintenance shed and because the cost of the new transportation
31 maintenance shed was less than $1,500,000, the Utah Department of Transportation did not
32 need to obtain, and did not obtain, legislative approval for construction of the new
33 transportation maintenance shed;
34 WHEREAS, when the town of Meadow, Utah became aware that the Department of
35 Transportation intended to demolish the old transportation maintenance shed, it offered to trade
36 land owned by Meadow to the Department of Transportation in exchange for the old
37 transportation maintenance shed and the land it is located upon;
38 WHEREAS, the Department of Transportation would like to exchange the old
39 transportation maintenance shed and land for the new property offered by Meadow; and
40 WHEREAS, if the Department of Transportation does not demolish the old
41 transportation maintenance shed, it will be in violation of Utah law for failing to obtain
42 legislative approval for the construction of the new transportation maintenance shed:
43 NOW, THEREFORE, BE IT RESOLVED that the Legislature approves the
44 construction of the new transportation maintenance shed for the Department of Transportation
45 near Meadow, Utah.
