9 General Description:
10 This bill modifies statutory provisions governing Utah's United States Congressional districts.
11 Highlighted Provisions:
12 This bill:
13 . repeals the four-member Congressional plan enacted in 2001;
14 . establishes new boundaries to create four United States Congressional districts in Utah;
15 . establishes certain maps as the legal boundaries of those Congressional districts;
16 . takes effect upon the occurrence of certain contingencies; and
17 . provides a legislative intent statement.

31 Be it enacted by the Legislature of the state of Utah:
32 Section 1. Section 20A-13-101 is repealed and reenacted to read:
33 20A-13-101. Representatives to the United States Congress -- Four representative
34 districts -- When elected -- District boundaries.
35 (1) (a) Utah is divided into four districts for the election of representatives to the Congress of
36 the United States, with one member to be elected from each Congressional district.
37 (b) At each general election held after this section takes effect, and at any special election
38 called by the governor to elect one or more members of Congress held within one year after this
39 section takes effect, one representative from each Congressional district shall be elected to serve in
40 the Congress of the United States.
41 (2) (a) The Legislature adopts the official census population figures and maps of the Bureau
42 of the Census of the United States Department of Commerce developed in connection with the taking
43 of the 2000 national decennial census as the official data for establishing Congressional district
44 boundaries.
45 (b) The numbers and boundaries of the Congressional districts are designated and
46 established by the maps attached to the bill that enacts this section.
47 Section 2. Repealer.
48 This bill repeals:
49 Chapter 7, Laws of Utah 2001, Second Special Session, which contains Section
50 20A-13-101 (Contingently Effective).
51 Section 3. Intent statement.
52 It is the intent of the Legislature that:
53 (1) the four Congressional districts enacted in this S.B. 5001 replace, on the dates that S.B.
54 5001 takes effect, the three Congressional districts repealed and reenacted in S.B. 2002, Chapter 6,
55 Laws of Utah 2001, Second Special Session; and
56 (2) if necessary, the governor convene the Legislature into a special session to resolve any
57 conflicts with statutory provisions governing the electoral process so that four Congressional
58 representatives can be elected as soon as reasonably possible.
59 Section 4. Contingent effective date.
60 (1) If approved by two-thirds of all the members elected to each house, Section 2, Repealer,
61 of this bill takes effect immediately upon approval by the governor, or the day following the
62 constitutional time limit of Utah Constitution Article VII, Section 8, without the governor's signature,
63 or in the case of a veto, the date of veto override.
64 (2) Section 1, Section 3, and Section 5 of this bill take effect:
65 (a) for purposes of nominating and electing members of the United States House of
66 Representatives, when the Clerk of the United States House of Representatives certifies to the state
67 of Utah that it is entitled to four representatives in the United States House of Representatives; and
68 (b) for all other purposes, on the date that the state board of canvassers declares four
69 Congressional representatives from Utah elected after the first statewide special or regular general
70 election held after the date that certification from the Clerk of the United States House of
71 Representatives is received.
72 Section 5. Revisor instructions.
73 When the provisions in this bill take effect as provided in Section 4, it is the intent of the
74 Legislature that the Office of Legislative Research and General Counsel:
75 (1) update the Utah Code database so that Section 20A-13-101 in this bill supersedes the
76 provisions of Section 20A-13-101 contained in S.B. 2002, Chapter 6, Laws of Utah 2001, Second
77 Special Session; and
78 (2) in Subsection 20A-13-101 (1)(b), replace "this section takes effect" with the actual
79 effective date of this bill.
