             8      LONG TITLE
             9      General Description:
             10          This bill modifies statutory provisions governing Utah's United States Congressional
             11      districts.
             12      Highlighted Provisions:
             13          This bill:
             14          .    repeals the four-member Congressional plan enacted in 2001;
             15          .    establishes new boundaries to create four United States Congressional districts in
             16      Utah;
             17          .    establishes certain maps as the legal boundaries of those Congressional districts;
             18          .    takes effect upon the occurrence of certain contingencies; and
             19          .    provides a legislative intent statement.
             20      Monies Appropriated in this Bill:
             21          None
             22      Other Special Clauses:
             23          This bill provides an immediate effective date for Section 2.
             24          This bill provides a contingent effective date for Sections 1, 3, and 5.
             25          This bill provides revisor instructions.

             29      Special Session
             30      REPEALS:
             31           Chapter 7, Laws of Utah 2001, Second Special Session
             32     
             33      Be it enacted by the Legislature of the state of Utah:
             34          Section 1. Section 20A-13-101 is repealed and reenacted to read:
             35          20A-13-101. Representatives to the United States Congress -- Four representative
             36      districts -- When elected -- District boundaries.
             37          (1) (a) Utah is divided into four districts for the election of representatives to the
             38      Congress of the United States, with one member to be elected from each Congressional district.
             39          (b) At each general election held after this section takes effect, and at any special
             40      election called by the governor to elect one or more members of Congress held within one year
             41      after this section takes effect, one representative from each Congressional district shall be
             42      elected to serve in the Congress of the United States.
             43          (2) (a) The Legislature adopts the official census population figures and maps of the
             44      Bureau of the Census of the United States Department of Commerce developed in connection
             45      with the taking of the 2000 national decennial census as the official data for establishing
             46      Congressional district boundaries.
             47          (b) The numbers and boundaries of the Congressional districts are designated and
             48      established by the maps attached to the bill that enacts this section.
             49          Section 2. Repealer.
             50          This bill repeals:
             51           Chapter 7, Laws of Utah 2001, Second Special Session, which contains Section
             52      20A-13-101 (Contingently Effective).
             53          Section 3. Intent statement.
             54          It is the intent of the Legislature that:
             55          (1) the four Congressional districts enacted in this S.B. 5001 replace, on the dates that
             56      S.B. 5001 takes effect, the three Congressional districts repealed and reenacted in S.B. 2002,
             57      Chapter 6, Laws of Utah 2001, Second Special Session; and
             58          (2) if necessary, the governor convene the Legislature into a special session to resolve


             59      any conflicts with statutory provisions governing the electoral process so that four
             60      Congressional representatives can be elected as soon as reasonably possible.
             61          Section 4. Contingent effective date.
             62          (1) If approved by two-thirds of all the members elected to each house, Section 2,
             63      Repealer, of this bill takes effect immediately upon approval by the governor, or the day
             64      following the constitutional time limit of Utah Constitution Article VII, Section 8, without the
             65      governor's signature, or in the case of a veto, the date of veto override.
             66          (2) Section 1, Section 3, and Section 5 of this bill take effect:
             67          (a) for purposes of nominating and electing members of the United States House of
             68      Representatives, when the Clerk of the United States House of Representatives certifies to the
             69      state of Utah that it is entitled to four representatives in the United States House of
             70      Representatives; and
             71          (b) for all other purposes, on the date that the state board of canvassers declares four
             72      Congressional representatives from Utah elected after the first statewide special or regular
             73      general election held after the date that certification from the Clerk of the United States House
             74      of Representatives is received.
             75          Section 5. Revisor instructions.
             76          When the provisions in this bill take effect as provided in Section 4, it is the intent of
             77      the Legislature that the Office of Legislative Research and General Counsel:
             78          (1) update the Utah Code database so that Section 20A-13-101 in this bill supersedes
             79      the provisions of Section 20A-13-101 contained in S.B. 2002, Chapter 6, Laws of Utah 2001,
             80      Second Special Session; and
             81          (2) in Subsection 20A-13-101 (1)(b), replace "this section takes effect" with the actual
             82      effective date of this bill.
