9 General Description:
10 This bill creates the State Facility Water Conservation Program.
11 Highlighted Provisions:

34 Be it enacted by the Legislature of the state of Utah:
35 Section 1. Section 63-9-68 is enacted to read:
36 63-9-68. State Facility Water Conservation Program.
37 (1) As used in this section:
38 (a) "Division" means the Division of Water Resources created in Section 73-10-18 .
39 (b) "State agency" means an executive, legislative, or judicial branch department,
40 agency, board, commission, or division, including a state institution of higher education as
41 defined in Section 53B-3-102 .
42 (c) (i) "State facility" means a building, structure, or other improvement that is
43 constructed on property owned by the state or a state agency.
44 (ii) "State facility" does not mean:
45 (A) an unoccupied structure that is a component of the state highway system;
46 (B) a privately owned structure that is located on property owned by the state or a state
47 agency; or
48 (C) a structure that is located on land administered by the School and Institutional
49 Trust Lands Administration under a lease, permit, or contract with the School and Institutional
50 Trust Lands Administration.
51 (d) "State Facility Water Conservation Program" means a program established under
52 this section for the purpose of improving water conservation and reducing water use at state
53 facilities.
54 (e) "Water conservation measure" means an action taken or initiated by a state agency
55 that reduces the state agency's water use.
56 (2) The division, in collaboration with the Division of Facilities Construction and
57 Management, created in Section 63A-5-201 , shall:
58 (a) develop and administer the State Facility Water Conservation Program, which shall
59 include guidelines and procedures to improve indoor and outdoor water conservation in the
60 maintenance and management of state facilities;
61 (b) provide information and assistance to state agencies in their efforts to improve
62 water conservation;
63 (c) analyze state facility water use to identify opportunities for improved water
64 conservation;
65 (d) identify and implement water conservation measures at state facilities; and
66 (e) submit a report to the governor and the Capital Facilities and Administrative
67 Services Appropriations Subcommittee by August 1, 2008 that:
68 (i) details water conservation projects and activities that were implemented as part of
69 the State Facility Water Conservation Program; and
70 (ii) identifies water conservation projects and activities that will be implemented in
71 future years as part of the State Facility Water Conservation Program.
72 (3) The Division of Facilities Construction and Management, created in Section
73 63A-5-201 , shall establish, in collaboration with the division, guidelines and procedures to
74 improve indoor and outdoor water conservation in the maintenance, management, and
75 construction of state facilities constructed or H. [
75a potential water-saving devices .H after May 1, 2007.
76 Section 2. Appropriation.
77 (1) There is appropriated $500,000 from the General Fund for fiscal year 2007-08 only,
78 to the Division of Water Resources.
79 (2) It is the intent of the Legislature that:
80 (a) the Division of Water Resources use the monies appropriated in Subsection (1) to
81 implement the State Facility Water Conservation Program; and
82 (b) this appropriation is nonlapsing.
