7 LONG TITLE
8 General Description:
9 This bill provides for the issuance of a request for proposals, and review of the
10 responses, to determine whether the Legislature should direct the Department of Human
11 Services to negotiate a contract with a private entity to operate and manage the Utah
12 State Hospital.
13 Highlighted Provisions:
14 This bill:
15 . defines terms;
16 . requires the Department of Human Services to issue a request for proposals for the
17 operation and management of the Utah State Hospital, or the operation,
18 management, and construction of a new facility for the Utah State Hospital;
19 . provides a timeline and other direction for the request for proposal process;
20 . provides for review of the responses to the request for proposals by the Executive
21 Appropriations Committee of the Legislature; and
22 . requires the Executive Appropriations Committee of the Legislature to determine
23 whether to recommend legislation for the 2008 General Session directing the
24 Department of Human Services to negotiate a contract with one of the entities that
25 responded to the request for proposals described in this bill.

29 This bill is repealed on March 5, 2008.

33 Be it enacted by the Legislature of the state of Utah:
34 Section 1. Definitions.
35 As used in this bill, "department" means the Department of Human Services.
36 Section 2. Request for proposals to operate and manage the Utah State Hospital --
37 Review and recommendation by the Executive Appropriations Committee of the
38 Legislature.
39 (1) In order to determine whether the Utah State Hospital could be operated more
40 efficiently by a private entity, the department shall issue a request for proposals for the
41 operation and management of the Utah State Hospital or for the operation, management, and
42 construction of a new facility for the Utah State Hospital.
43 (2) The request for proposals described in this bill shall:
44 (a) be issued on or before July 1, 2007;
45 (b) set a deadline for responses to the request for proposals that is no later than
46 November 1, 2007;
47 (c) request proposals to:
48 (i) operate and manage the Utah State Hospital at the existing facility, beginning on
49 July 1, 2008; or
50 (ii) (A) construct a new facility for the Utah State Hospital;
51 (B) operate and manage the Utah State Hospital at the existing facility, beginning on
52 July 1, 2008, until operation begins at the new facility; and
53 (C) operate and manage the Utah State Hospital at the new facility when the new
54 facility is ready for use; and
55 (d) contain a statement indicating that the request for proposals is issued for the
56 following purposes:
57 (i) to determine whether the department should enter into a contract with a private
58 entity for the purposes described in Subsection (2)(c); and

59 (ii) if the Legislature determines that the department should enter into the contract
60 described in Subsection (2)(d)(i), to select the private entity that the department should enter
61 into the contract with.
62 (3) On or before the December meeting of the Executive Appropriations Committee of
63 the Legislature, the department shall submit the responses to the request for proposals
64 described in this section to the Executive Appropriations Committee of the Legislature for
65 review.
66 (4) After reviewing the responses described in Subsection (3), the Executive
67 Appropriations Committee of the Legislature shall determine whether to recommend
68 legislation for the 2008 General Session directing the department to negotiate a contract with
69 one of the entities that responded to the request for proposals described in this bill.
70 Section 3. Repeal date.
71 This bill is repealed on March 5, 2008.
