Rep. Menlove called the meeting to order at 8:10 a.m.

MOTION:    Rep. Litvack moved to approve the minutes of the February 2, 2007 meeting. The motion passed unanimously with Rep. Riesen and Rep. Ray absent for the vote.


H.B. 114    Prisoner Long-term Health Care (Rep. J. Biskupski)

Rep. Biskupski presented H.B. 114 to the committee, assisted by Ann Hart, a former long-term care ombudsman for Salt Lake County.

MOTION:    Rep. Litvack moved to delete in title and body H.B. 114 and replace it with
        1st Substitute H.B. 114, "Prisoner Long-term Health Care." The motion passed unanimously with Rep. Riesen absent for the vote.

MOTION:    Rep. Ray moved to pass 1st Substitute H.B. 114 out favorably. The motion passed unanimously with Rep. Riesen absent for the vote.

MOTION:    Rep. Litvack moved to place 1st Substitute H.B. 114 on the Consent Calendar. The motion passed unanimously with Rep. Riesen absent for the vote.


H.B. 242    Medicaid False Claims Act Amendments (Rep. B. Last)

MOTION:    Rep. Buxton moved to delete in title and body H.B. 242 and replace it with
        1st Substitute H.B. 242, "Medicaid False Claims Act Amendments." The motion passed unanimously with Rep. Litvack and Rep. Riesen absent for the vote.




MOTION:    Rep. Dougall moved to amend 1st Substitute H.B. 242 as follows:

1.    Page 7, Lines 182 through 183 :    

             182          (a) [in all cases, shall be required to] make full and complete restitution to the state of
             183      all
{   medical benefits improperly obtained   }        damages that the state sustains because of the person's violation of this chapter       ;


The motion passed unanimously with Rep. Litvack and Rep. Riesen absent for the vote.

Rep. Last presented 1st Substitute H.B. 242 as amended to the committee. He was assisted by David Stallard, Attorney General's Office, who provided a handout to the committee.

Rep. Newbold presented H.B. 245 to the committee.

H.B. 313    Administration of Medication to Students Amendments (Rep. R. Lockhart)

Rep. Lockhart presented H.B. 313 to the committee.

MOTION:    Rep. Dougall moved to pass H.B. 313 out favorably. The motion passed with Rep. Menlove voting in opposition to the motion and Rep. Harper absent for the vote.

H.B. 358    Cervical Cancer Prevention (Rep. K. Morgan)

Rep. Morgan presented H.B. 358 to the committee.

MOTION:    Rep. Ray moved to amend H.B. 358 as follows:

1.    Page 1, Lines 12 through 14 :    

             12          .    authorizes the Department of Health to establish a program to educate citizens about
             13      the risks of cervical cancer and prevention of cervical cancer
{   and to begin an

             14      immunization program for cervical cancer  
}
.

2.    Page 2, Lines 30 through 36 :    

                 
             30      to reduce or eliminate the incidence of cervical cancer in the state
{   , including providing an

             31      immunization program for cervical cancer  
}

             32          Section 2. Appropriation.
             33          As an ongoing appropriation subject to future budget constraints, there is appropriated
             34      from the General Fund for fiscal year 2007-08, $1,000,000 to the Department of Health for
             35      establishing the education
{   and immunization   } program for cervical cancer prevention as

             36      described in Section 26-7-3 .



SUBSTITUTE
MOTION:    Rep. Dougall moved to amend H.B. 358 as follows:

1.    Page 1, Lines 12 through 14 :    

             12          .    authorizes the Department of Health to establish a program to educate citizens about

2.    Page 2, Lines 28 through 36 :

MOTION:    Rep. Riesen moved to pass H.B. 358 as amended out favorably. The motion failed on a tied vote with Rep. Litvack, Rep. Riesen, Rep. Menlove, and Rep. Ray voting in favor of the motion. Rep. Buxton, Rep. Dougall, Rep. Harper, and Rep. Sandstrom voted in opposition to the motion.




MOTION:    Rep. Ray moved to adjourn the meeting. The motion passed unanimously.

Rep. Menlove adjourned the meeting at 9:52 a.m.
