Rep. Hunsaker called the meeting to order at 8:19 a.m.

MOTION:    Rep. Gibson moved to approve the minutes of January 18, 2007. The motion passed unanimously, with Rep. Allen, Rep. Becker, Rep. Seelig, Rep. Shurtliff, Rep. Urquhart, and Rep. Wyatt absent for the vote. In accordance with House Rule 24.11, a quorum was present for the vote.

H.B. 201    Governance of Local Ordinances Regarding Smoking (Rep. P. Ray)

Rep. Ray introduced and explained the bill to the Committee.

MOTION:    Rep. Dunnigan moved that the Committee recommend H.B. 201 favorably. The motion passed unanimously, with Rep. Becker, Rep. Seelig, Rep. Shurtliff, Rep. Urquhart, and Rep. Wyatt absent for the vote.

S.J.R. 1    Utah Athletic Foundation Resolution (Sen. D. Eastman)

Sen. Eastman introduced and explained the bill to the Committee, with the help of Colin Hilton, CEO, Utah Athletic Foundation.


MOTION:    Rep. Gibson moved to amend S.J.R. 1 as follows:

1.    Page 3, Lines 80 through 86 :    

             80          (2) the board of directors of the Foundation shall ensure that any transaction involving
             81      a sale of a portion of the Winter Sports Park provides for a fair return on the value of the real
             82      property being sold by the Foundation
{   including by:

             83          (a) direct sale;
             84          (b) joint venture;
             85          (c) a partnership; or
             86          (d) other financial participation in the transaction  
}
  and does not result in the Foundation bearing any financial risk for the development or use of the portion of the Winter Sports Park that is sold after the sale of that portion of the Winter Sports Park       ;


The motion passed unanimously, with Rep. Becker, Rep. Seelig, Rep. Shurtliff, and Rep. Wyatt absent for the vote.

MOTION:    Rep. Gibson moved that the Committee recommend S.J.R 1 favorably as amended. The motion passed unanimously, with Rep. Becker, Rep. Shurtliff, and Rep. Wyatt absent for the vote.

H.B. 222    Open and Public Meetings - Electronic Notice (Rep. J. Dougall)

Rep. Dougall introduced and explained the bill to the Committee.

MOTION:    Rep. Urquhart moved to amend H.B. 222 as follows:

1.    Page 2, Line 36 :    

             36          (b) give public notice of its meeting pursuant to Section 52-4-202
{   by   } [:].


2.    Page 3, Line 78 through Page 4, Line 93 :    

             78          (3) Public notice shall be satisfied by:
             79          (a) posting written notice:
             80          (i) at the principal office of the public body, or if no principal office exists, at the
             81      building where the meeting is to be held; and


             82          (ii) on the Internet, in a manner that is easily accessible to citizens that use the Internet;
             83      and
             84          (b) providing
  electronic       notice to      {   :

             85          (i) at least one newspaper of general circulation within the geographic jurisdiction of
             86      the public body; or
             87          (ii) a local media correspondent  
}
  individuals that have requested the notification       .

             88          [(4) A public body is encouraged to:]
             89          [(a) develop and use electronic means to provide notice of its meetings under
             90      Subsection (3)(b);]
             91          [(b) provide public notice to all other media agencies that make a periodic written
             92      request to receive them; and]
             93          [(c) post public notice of its meetings on the Internet.]

Rep. Urquhart withdrew his motion to amend H.B. 222.

MOTION:    Rep. Urquhart moved that the Committee recommend H.B. 222 favorably.

SUBSTITUTE
MOTION:     Rep. Allen moved to adjourn the meeting. The motion passed with Rep. Allen, Rep. Buxton, Rep. Dunnigan, Rep. Seelig, and Rep. Urquhart voting in favor of the motion, and Rep. Froerer, Rep. Gibson, and Rep. Hunsaker voting against the motion, with Rep. Becker and Rep. Wyatt absent for the vote.

Rep. Hunsaker adjourned the meeting at 9:10 a.m.
