Rep. Noel called the meeting to order at 3:00 p.m.

MOTION:    Rep.Wheeler moved to approve the minutes of January 26, 2007. The motion passed unanimously with Rep. Brown, Rep. Fisher and Rep. McIff absent for the vote.

H.B. 120    Utility Facility Review Board (Rep. A. Tilton)

MOTION:    Rep. Tilton moved to delete in title and body H.B. 120 and replace it with 1st Substitute H. B, 120. The motion passed unanimously with Rep. Fisher absent for the vote.
Rep. Tilton introduced the bill with the assistance of Rey Butcher, Questar.

Spoke to the bill:    Tom Bingham, Utah Manufacturers Association
            Jodi Hoffman, Utah League of Cities and Towns
            Kevin Boardman, Rocky Mountain Power

MOTION:    Rep. Hunsaker moved to pass 1st Substitute H.B. 120 out favorably. The motion passed unanimously with Rep. Wheeler absent for the vote.

Rep. Noel relinquished the chair to Rep. Hunsaker.

H.B. 188    Easements - Counties and Municipalities (Rep. A. Tilton)

MOTION:    Rep. Tilton moved to amend the bill as follows:



1.     Page 2, Line 35:        After "acquires" delete "an" insert "a utility"

The motion passed unanimously with Rep. Wheeler and Rep. Noel absent for the vote.

Spoke to the bill:    LeGrand Bitter, Director, Utah Association of Special Districts
            Rey Butcher, Questar
            Jeff Richards, Rocky Mountain Power
            Mike Peterson, Executive Director, Utah Rural Electric Assn.

MOTION:    Rep. McIff moved to pass the bill out favorably as amended. The motion passed with Rep. Fisher voting in opposition. Rep. McIff, Rep. Noel and Rep. Wheeler were absent for the vote.

H.B. 315    Regulation of Electric Personal Assistive Mobility Devices (Rep. A. Tilton)

Rep. Tilton explained the bill.

Spoke in favor of the bill:    David Purinton, President, SEGWAY OF UTAH

MOTION:    Rep. Brown moved to pass the bill out favorably. The motion passed unanimously with Rep. McIff and Rep. Noel absent for the vote.

Rep. Noel resumed the chair.

H.B. 333    Materials Harmful to Minors (Rep. A. Tilton)

Rep. Tilton explained the bill with the assistance of Patricia Owen, Office of Legislative Research and General Counsel.

MOTION:    Rep. Mascaro moved to pass the bill out favorably. The motion passed unanimously with Rep. McIff and Rep. Wheeler absent for the vote.

MOTION:    Rep. Brown moved to adjourn. The motion passed unanimously with Rep. McIff and Rep. Wheeler absent for the vote. Rep. Noel adjourned the meeting at 4:26 p.m.
