Chair VanTassell called the meeting to order at 8:16 a.m.

Approval of Minutes

    MOTION:
Sen. Niederhauser moved to approve the minutes of February 7, 2007.

    The motion passed unanimously.

1.    S.B. 261 Disposition of Real Property
(W. Niederhauser)

    
Sen. Niederhauser introduced the bill and the following amendments were distributed:


1.    Page 1, Lines 15 through 16 :    

             15          .    provides a process for a county's or municipality's disposition of property valued at


             16      more than $
{   25,000   }        50,000       ; and


2.    Page 4, Line 113 :    

             113      personal property with a fair market value of more than $
{   25,000   }        50,000       , the municipality shall:


3.    Page 4, Line 120 through Page 5, Line 128 :    

             120          (d) (i) For disposition of a parcel of real property, notice under Subsection (4)(c)(i)
             121      shall be mailed at least
{   14   }        10       days before the proposed disposition to the owner of any parcel of

             122      real property within
{   500   }        300       feet of the boundaries of the real property proposed for disposition.

             123          (ii) "Parcel of real property" as used in Subsection (4)(d)(i) means any:
             124          (A) real estate;
             125          (B) present interest in real estate;
             126          (C) future interest in real estate;
             127          (D) future development right; or
             128          (E) other interest in land, whether or not currently in public use.
    
  (iii) "Parcel of real property" as used in Subsection (4)(d)(i) does not include:

    (A) an easement for use in connection with a road or the provision of utility service; or
    (B) a donation or sale of land to the Department of Transportation created in Section 72-1-201.  

    

    
MOTION: Chair VanTassell moved to adopt the amendments.

    The motion passed unanimously.

    Lynn Pace, Deputy City Attorney, Salt Lake City, expressed concerns with the bill.

     MOTION: Sen. Niederhauser moved to pass the bill out favorably, as amended, and with a     commitment to continue working with interested parties.

    The motion passed unanimously.

2.    S.B. 176 Utah Business Assistance Center Pilot (D. Stowell)

    
Sen. Stowell introduced the bill.


    Wes Curtis, Assistant to the President, Southern Utah University, further explained the bill     and answered questions from the committee.

    MOTION: Sen. Niederhauser moved to pass the bill out favorably, with a commitment
    
to review the program in three years.

    The motion passed unanimously.

3.    H.B. 261 Expiration of Gift Certificates (W. Harper)
    
    
Rep. Harper introduced the bill.

     MOTION: Sen. Niederhauser moved to pass the bill out favorably.

    The motion passed unanimously.

4.    H.B. 130 Funeral Services Licensing Act Amendments (K. McIff)

    
Rep. McIff introduced the bill and the following amendment was distributed:


1.    Page 5, Lines 146 through 147 :    

             146          (a) assist a funeral service director in the embalming or other preparation of a dead
             147      human body for
{   deposition   }        disposition       ;



     MOTION: Sen. Niederhauser moved to adopt the amendment.

    The motion passed unanimously.

     MOTION: Sen. Niederhauser moved to pass the bill out favorably.

    The motion passed unanimously.

     MOTION: Chair VanTassell moved to place the bill on the Consent Calendar.

    The motion passed unanimously.    

5.    1st Sub. H.B. 218 Utah Children's Health Insurance Program
(J. Dunnigan)

    
Rep. Dunnigan introduced the bill and 3rd Sub.H.B. 218 was distributed.

     MOTION: Sen. Niederhauser moved to adopt 3rd Sub. H.B. 218.



    
The motion passed unanimously.

    David N. Sundwall, Executive Director, Utah Department of Health, and Sheila Walsh-     McDonald, Health Care Advocate, Salt Lake Community Action Program, spoke in support     of the substitute bill.

     MOTION: Sen. Niederhauser moved to pass 3rd Sub. H.B. 218 out favorably.

    The motion passed unanimously.

     MOTION: Sen. Niederhauser moved to adjourn.

    The motion passed unanimously at 9:05 a.m.
