Chair VanTassell called the meeting to order at 4:11 p.m.

Approval of Minutes

    MOTION:
Sen. Eastman moved to approve the minutes of February 19, 2007.

    The motion passed unanimously with Sen. Davis absent for the vote.

1.    S.B. 78 Protection of Constitutionally Guaranteed Activities in Certain Private Venues
    
(M. Madsen)

    
Sen. Madsen introduced the bill.


    Steven H. Gunn, Attorney; Dee Rowland, Chair, Gun Violence Prevention Campaign; and     Jim Olsen, President, Utah Food Industry Association; spoke in opposition to the bill.

    Clark Aposhian, Utah Shooting Sports Council, National Rifle Association, and Charles     Hardy, Public Policy Director, Gun Owners of Utah, spoke in support of the bill.

     MOTION: Sen. Mayne moved to pass the bill out favorably.

    The motion passed unanimously.

2.    S.B. 201 Rights of Citizens to Carry Firearms in Declared Emergency (M. Madsen)

    Sen. Madsen introduced the bill and the following amendment was distributed:


1.    Page 2, Lines 53 through 54 :    

             53          (i) for damages, in the maximum amount of $10,000, against a person who
{   allegedly   }

             54      violates Subsection (2)(b);

    MOTION: Sen. Davis moved to adopt the amendment.

    The motion passed unanimously with Sen. Mayne absent for the vote.     
    Charles Hardy, Public Policy Director, Gun Owners of Utah, spoke in support of the bill.

    Steven H. Gunn, Attorney, spoke in opposition to the bill.

     MOTION: Sen. Eastman moved to pass the bill out favorably as amended.

    The motion passed with Sen. Davis voting in opposition and Sen. Mayne absent for the vote.     
3.    S.B. 236 Trademark Protection Act (D. Eastman)

    
Sen. Eastman introduced the bill and the following amendment was distributed:


1.    Page 12, Line 338 :    

             338          (2)
  (a)       The division may contract with a person to maintain and operate the database.


            (b) If the division contracts with a person to maintain and operate the database, the person with whom the division contracts is responsible for all costs of creating the database and readying it for use.      


    
     MOTION: Sen. Walker moved to adopt the amendment.

    The motion passed unanimously with Sen. Mayne absent for the vote.

    Craig Peterson, Consultant, CAP Consulting, spoke in support of the bill.

     MOTION: Sen. Davis moved to pass the bill out favorably as amended.

    The motion passed unanimously with Sen. Mayne absent for the vote.

4.    H.B. 146 County Tax Sales of Property (M. Morley)

    
Rep. Morley introduced the bill.

     MOTION: Sen. Niederhauser moved to pass the bill out favorably.
    
    The motion passed unanimously.

5.    1st Sub. H.B. 273 Indoor Smoking Amendments (C. Oda)

    
Rep. Oda introduced the bill.

    Kasey Hill, American Heart Association, spoke for moving the effective date to January 1,     2008.

    Bill Christoffersen, American Legion, spoke in support the bill.

     MOTION: Sen. Walker moved to pass the bill out favorably.

    The motion passed unanimously.

6.    S.B. 253 Sales and Use Tax Exemption for Railroad Common Carrier Locomotive     Engine Fuel (P. Knudson)

    
Sen. Knudson introduced the bill.


    Doug Foxley, Union Pacific Railroad, spoke in support of the bill.

    Bruce Johnson, Utah Tax Commission, spoke to the bill.

     MOTION: Sen. Davis moved to go to the next item on the agenda.

    The motion passed unanimously.

7.    H.J.R. 4 Resolution Revising Executive Officer Succession Provisions (S. Urquhart)

    
Rep. Urquhart introduced the resolution.

     MOTION: Sen. Mayne moved to pass H.J.R. 4 out favorably.

    The motion passed unanimously.

     MOTION: Sen Davis moved to adjourn.

    The motion passed unanimously at 5:43 p.m.
