Chair Bell called the meeting to order at 9:05 a.m.
Approval of Minutes
MOTION: Sen. McCoy moved to approve the minutes of Tuesday, January 16, 2007.
The motion passed unanimously with Sen. Madsen absent for the vote.
1. S.B. 129 Private Investigator Regulation Act Amendments (D.C. Buttars)
The bill was not considered by request of the sponsor.
2. S.B. 136 Unlawful Detainer Amendments (M. Waddoups)
The bill was not considered by request of the sponsor.
3. S.J.R. 10 Joint Resolution Supporting Garfield County Expansion of Correctional Facilities (D. Stowell)
Sen. Stowell explained the resolution and requested that the following amendment be the considered:
1. Page 2, Line 32:
32 WHEREAS, the approximate additional number of beds to be contracted in Garfield County is 80;
MOTION: Sen. McCoy moved to adopt the amendment to the resolution.
The motion passed unanimously with Sen. Madsen absent for the vote.
Executive Director Tom Patterson, Utah Corrections, spoke in favor of the resolution.
Commissioner D. Maloy Dodds, Garfield County Commission, spoke in favor of the resolution.
MOTION: Sen. Greiner moved to transmit the resolution, as amended, with a favorable recommendation.
The motion passed unanimously with Sen. Madsen absent for the vote.
4. H.B. 4 Organized Retail Theft (P. Ray)
Rep. Ray explained the bill.
President Jim Olsen, Utah Retail Merchants Association, spoke to the bill.
Chad Platt, Deputy District Attorney, SWAPLAC, assisted in the explanation of the bill and responded to questions.
Commissioner Scott Carver, Sentencing Commission, spoke in favor of the bill.
MOTION: Sen. Romero moved to transmit the bill with a favorable recommendation.
The motion passed unanimously.
5. H.B. 5 Internet Sexual Predator Penalties (P. Ray)
Rep. Ray explained the bill and responded to questions.
Commissioner Scott Carver, Sentencing Commission, spoke in favor of the bill.
Tracey Skinner, Deputy District Attorney, SWAPLAC, clarified the bill.
MOTION: Sen. Greiner moved to transmit the bill with a favorable recommendation.
The motion passed unanimously.
6. H.B. 6 Controlled Substance Database Amendments (R. Menlove)
Rep. Menlove explained the bill.
Marvin Sims, DOPPL, Controlled Substance Database, spoke to the bill and stated that the Department remains neutral on the bill.
MOTION: Sen. McCoy moved to transmit the bill with a favorable recommendation.
The motion passed unanimously.
MOTION: Sen. McCoy moved to place H.B. 6 on the Consent Calendar.
