Acting Committee Chair Christensen called the meeting to order at 8:15 a.m.

1.    Approval of Minutes

     MOTION: Sen. Dayton moved to approve the minutes of February 2, 2007.

    The motion passed unanimously with Sen. Davis and Sen. Stowell absent at the time of voting.

2.    H.B. 97 Motor Vehicle Registration Checkoff for Protecting Access to Public Lands and Off-     highway Vehicle Education (Rep. M. Noel)



    Rep. Michael Noel introduced the bill. Michael Swenson, Executive Director, Utah Shares Access Alliance assisted in the presentation.

    Mary Van Buren, Tread Lightly, spoke in opposition to the bill.

    Rod Marrelli, Executive Director, Utah Tax Commission spoke to the bill.

     MOTION: Sen. Dayton moved to pass H.B. 97, Motor Vehicle Registration Checkoff for Protecting     Access to Public Lands and Off-highway Vehicle Education, out favorably.

    The motion passed unanimously with Sen. Davis absent at the time of voting.

3.    Corrected Approval of Minutes

    MOTION:
Sen. Dayton moved to accept corrected minutes of February 2, 2007, as follows:

    On page 5 of the minutes, Sen. Dayton assumed the chair from Sen. Waddoups during public testimony, and Sen. Peterson assumed the chair from Sen. Dayton after the motion to pass 1st Sub. S.B. 195 out passed.

    The motion passed unanimously, with Sen. Davis absent at the time of voting.

4.     H.B. 99 Water Loan Program Amendments (Rep. P. Painter)

    Rep. Patrick Painter introduced the bill. Walt Baker, Director, Division of Water Quality, DEQ, assisted in the presentation. A handout was distributed.

    Leland Myers, Manager, Central Davis Sewer District, and Amy Defreese, Utah River Council spoke in support of the bill.

     MOTION: Sen. Stowell moved to pass H.B. 99, Water Loan Program Amendments, out favorably.

    The motion passed unanimously.

5.    H.B. 221 Timing to Commence a Civil Action by the Department of Environmental Quality     (Rep. R. Menlove)

    Rep. Ronda Menlove introduced the bill. A handout was distributed. Raymond Wixom, Assistant     Attorney General, DEQ, assisted in the presentation.

     MOTION: Sen. Dayton moved to pass H.B. 221, Timing to Commence a Civil Action by the Department of Environmental Quality, out favorably.

    The motion passed unanimously.

     MOTION: Sen. Davis moved to place H.B. 221 on the Consent Calendar.



    The motion passed unanimously.

6.    S.B. 207 Waste Tire Recycling Act Revisions (Sen. F. Fife)

    Sen. Fife introduced the bill. A handout was distributed.

     MOTION: Sen. Fife moved to replace S.B. 207 with 1st Sub. S.B. 207, Waste Tire Recycling Act Revisions.

    The motion passed unanimously.

    Dennis Downs, Director, Division of Solid and Hazardous Waste, Dept. of Environmental Quality, spoke in support of the bill.

     MOTION: Sen. Davis moved to pass 1st Sub. S.B. 207, Waste Tire Recycling Act Revisions, out favorably.

    The motion failed with Sen. Davis, Sen. Fife and Sen. Stowell voting in support and Sen. Christensen, Sen. Dayton and Sen. Waddoups voting in opposition.


7.    S.B. 243 Direct-entry Midwife Amendments (Sen. M. Dayton)

    Sen. Dayton introduced the bill. Catherine Wheeler, M.D., Utah Medical Association, and R. C. Loftis, Attorney, Utah Medical Association, assisted in the presentation.

     MOTION: Sen. Dayton moved to replace S.B. 243 with 1st Sub. S.B. 243, Direct-entry Midwife     Amendments.

    The motion passed unanimously.

    Jennifer Brinton, M.D., Intermountain Pediatric Society, and Cynthia Jones, M.D., American College of Gynocologists spoke in support of the bill.

    Joshua Der, Utah Friends of Midwives, Laura Lund, Utah Friends of Midwives; Raeann Peck, Direct-entry Midwife; and Suzanne Smith, Direct-entry Midwife, spoke in opposition to the bill.

    Laura Poe, Bureau Manager, DOPL, spoke to the bill.

     MOTION: Sen. Davis moved to adjourn.

    The motion failed with Sen. Davis and Sen. Fife voting in support, and Sen. Christensen, Sen. Dayton, Sen. Stowell and Sen. Waddoups voting in opposition.

     MOTION: Sen. Dayton moved to pass 1st Sub. S.B. 243, Direct-entry Midwife Amendments, out favorably.



    The motion passed with Sen. Christensen, Sen. Dayton, Sen. Stowell and Sen. Waddoups voting in support, and Sen. Davis and Sen. Fife voting in opposition.

     MOTION: Sen. Stowell moved to adjourn.

    The motion passed unanimously.

    Acting Chair Christensen adjourned the meeting at 9:58 a.m.
