Committee Chair Peterson called the meeting to order at 4:20 p.m.

1.    Approval of Minutes

     MOTION: Sen. Christensen moved to approve the minutes of February 12, 2007.

    The motion passed unanimously with Sen. Davis, Sen. Stowell and Sen. Waddoups absent at the time of voting.

2. 1st Sub. H.B. 102 Land and Water Reinvestment (Rep. D. Clark)

    Rep. David Clark introduced the bill.

    David Litvin, Utah Mining Association; Todd Bingham, Utah Farm Bureau Federation, and Bill Rigby, Utah Association of Conservation Districts, spoke in support of the bill.

     MOTION: Sen. Christensen moved to pass 1st Sub. H.B. 102, Land and Water Reinvestment, out favorably.

    The motion passed unanimously with Sen. Davis and Sen. Stowell absent at the time of voting.

3.    H.B. 135 Utah Uniform Building Standards Act Amendments (Rep. L. Wiley)

    
Rep. Larry Wiley introduced the bill.



     MOTION: Sen. Fife moved to adopt the following amendment:

1.    Page 2, Lines 52 through 56 :    

             52          (4) "Compliance agency" means
  :

(a)  
an agency of the state or any of its political

             53      subdivisions which issues permits for construction regulated under the codes
[[   , or   ]]        ;

(b)  
any other

             54      agency of the state or its political subdivisions specifically empowered to enforce compliance
             55      with the codes
  ;or

(c) any other state agency which chooses to enforce codes adpoted under this chapter by authority given the agency under a title other than Title 58, Occupations and Professions  
.

             56          (5) "Factory built housing" means manufactured homes or mobile homes.

    The motion passed unanimously with Sen. Davis and Sen. Stowell absent at the time of voting.

     MOTION: Sen. Fife moved to pass H.B. 135, Utah Uniform Building Standards Act Amendments,     out favorably as amended.     

    The motion passed unanimously with Sen. Davis and Sen. Stowell absent at the time of voting.

     MOTION: Sen. Fife moved to place H.B. 135 on the Consent Calendar.

    The motion passed unanimously with Sen. Davis absent at the time of voting.

4.    H.B. 145 Farmers Market Exemptions (Rep. R. Menlove)

    Rep. Ronda Menlove introduced the bill. Todd Bingham, Utah Farm Bureau Federation, assisted in the presentation.

    
MOTION: Sen. Dayton moved to adopt the following amendment:

1.    Page 3, Lines 59 through 60 :    

             59          (5) "Farmers market" means a
[[   public   ]] market where producers of food products sell

             60      only fresh, raw, whole, unprocessed, and unprepared food items directly to the
[[   public   ]]        final consumer       .


    The motion passed unanimously with Sen. Davis absent at the time of voting.



     Kyle LaMalfa, Director, Peoples Market, spoke in opposition to the bill.

    Bill Rigby, Utah Association of Conservation Districts, and Kyle Stephens, Deputy Commissioner, Utah Dept. of Agriculture and Food, spoke in support of the bill.

     MOTION: Sen. Davis moved to pass H.B. 145, Farmers Market Exemptions, out favorably as amended.

    The motion passed unanimously with Sen. Dayton absent at the time of voting.

5.    H.C.R. 1 Concurrent Resolution Approving the Interlocal Agreement Creating the Utah Lake Commission (Rep. S. Clark)

    
Rep. Stephen Clark introduced the bill.

    Todd Bingham, Utah Farm Bureau Federation, spoke to the bill.

     MOTION: Sen. Christensen moved to pass H.C.R. 1, Concurrent Resolution Approving the Interlocal Agreement Creating the Utah Lake Commission, out favorably.

    The motion passed unanimously with Sen. Davis and Sen. Dayton absent at the time of voting.

     MOTION: Sen. Christensen moved to place H.C.R. 1 on the Consent Calendar.

    The motion passed unanimously with Sen. Davis and Sen. Dayton absent at the time of voting.
    
     MOTION: Sen. Christensen moved to adjourn.

    The motion passed unanimously with Sen. Davis and Sen. Dayton absent at the time of voting.

    Chair Peterson adjourned the meeting at 5:02 p.m.
