8 LONG TITLE
9 General Description:
10 This bill provides an appropriation for existing inmate postsecondary education.
11 Highlighted Provisions:
12 This bill:
13 . appropriates money to the State Board of Regents to distribute to institutions of
14 higher education that currently provide inmate postsecondary education under the
15 supervision of the Utah Department of Corrections;
16 . requires participating inmates to pay affordable tuition to help offset the state costs
17 of providing the education;
18 . limits the education to inmates who have a legal presence in the United States; and
19 . designates the appropriation as nonlapsing.
20 Monies Appropriated in this Bill:
21 This bill appropriates:
22 . as an ongoing appropriation subject to future budget constraints, $150,000 from the
23 Education Fund for fiscal year 2008-09 to the State Board of Regents.
24 Other Special Clauses:
25 This bill takes effect on July 1, 2008.

29 Be it enacted by the Legislature of the state of Utah:
30 Section 1. Appropriation.
31 (1) As an ongoing appropriation subject to future budget constraints, there is
32 appropriated from the Education Fund for fiscal year 2008-09, $150,000 to the State Board of
33 Regents.
34 (2) It is the intent of the Legislature that the appropriation described under Subsection
35 (1) shall be distributed by the State Board of Regents to institutions of higher education that
36 provide inmate postsecondary education under the supervision of the Utah Department of
37 Corrections to:
38 (a) stabilize the funding of existing postsecondary education programs;
39 (b) primarily reimburse the personnel costs of providing the inmate postsecondary
40 education; and
41 (c) purchase necessary equipment and supplies for the inmate postsecondary education.
42 (3) It is the intent of the Legislature that the institutions of higher education that
43 provide inmate postsecondary education:
44 (a) shall require participating inmates to pay affordable tuition to help offset the state
45 costs of providing the education; and
46 (b) may only offer the education to an inmate who has a legal presence in the United
47 States.
48 (4) The appropriation described under Subsection (1) is nonlapsing.
49 Section 2. Effective date.
50 This bill takes effect on July 1, 2008.
