             10          The Health and Human Services Interim Committee recommended this bill.
             11      General Description:
             12          This bill expands the Department of Health's breast cancer mortality reduction program
             13      to include other cancers and provides additional funding to the program.
             14      Highlighted Provisions:
             15          This bill:
             16          .    expands the Department of Health's breast cancer mortality reduction program to
             17      include other cancers;
             18          .    identifies the program as the "Cancer Screening and Mortality Reduction Program";
             19      and
             20          .    deletes a reference to a mammogram quality assurance advisory committee which
             21      no longer exists.
             22      Monies Appropriated in this Bill:
             23          This bill appropriates:
             24          .    as an ongoing appropriation subject to future budget constraints, $2,300,000 from
             25      the General Fund for fiscal year 2008-09 to the Department of Health.

             40      Be it enacted by the Legislature of the state of Utah:
             41          Section 1. Section 26-21a-101.5 is enacted to read:

CHAPTER 21a. UTAH CANCER SCREENING AND MORTALITY

REDUCTION ACT

             44     
Part 1. Title

             45          26-21a-101.5. Title.
             46          This chapter is known as the "Utah Cancer Screening and Mortality Reduction Act."
             47          Section 2. Section 26-21a-202.5 , which is renumbered from Section 26-21a-101 is
             48      renumbered and amended to read:
             49     
Part 2. Mammogram Quality Assurance

             50           [26-21a-101].     26-21a-202.5. Definitions.
             51          As used in this [chapter] part:
             52          (1) "Breast cancer screening mammography" means a standard two-view per breast,
             53      low-dose as defined by the National Cancer Institute, radiographic examination of the breasts
             54      to detect unsuspected breast cancer using equipment designed and dedicated specifically for
             55      mammography.
             56          (2) "Diagnostic mammography" means mammography performed on a woman having
             57      suspected breast cancer.
             58          (3) "Facility" means a facility that provides screening or diagnostic breast


             59      mammography services.
             60          Section 3. Section 26-21a-205 is amended to read:
             61           26-21a-205. Department duties.
             62          The department shall:
             63          (1) enforce rules established under this part;
             64          (2) authorize qualified department agents to conduct inspections of mammogram
             65      facilities under department rules; and
             66          (3) collect and credit fees for certification under Section 63-38-3.2 [; and].
             67          [(4) provide necessary administrative and staff support to the committee.]
             68          Section 4. Section 26-21a-301 is amended to read:
             69     
Part 3. Cancer Screening and Mortality Reduction Program

             70           26-21a-301. Breast cancer mortality reduction program.
             71          The department shall create a [breast cancer mortality reduction program] Cancer
             72      Screening and Mortality Reduction Program. The program shall include:
             73          (1) education programs for health professionals regarding skills in cancer screening,
             74      diagnosis, referral, treatment, and rehabilitation based on current scientific knowledge;
             75          (2) education programs to assist the public in understanding:
             76          (a) the benefits of regular screening for breast cancer [screening], cervical cancer,
             77      colorectal cancer, and other cancers;
             78          (b) resources available in the [medical] health care system for cancer screening,
             79      diagnosis, referral, treatment, and rehabilitation, including the subsidies available under
             80      Subsection (3); and
             81          (c) available options for treatment of [breast] various types of cancer and the
             82      ramifications of each approach; and
             83          [(3) subsidized screening mammography for low-income women as determined by the
             84      department standards.]
             85          (3) as established by department rule in accordance with Title 63, Chapter 46a, Utah
             86      Administrative Rulemaking Act, and within available funding, subsidies for the following
             87      cancer screenings for persons with household incomes not more than 250% of the federal
             88      poverty level:
             89          (a) breast and cervical cancer screening for women who are at least 40 but less than 50


             90      years of age;
             91          (b) colorectal screening for persons 50 years of age or older; and
             92          (c) screenings for other types of cancer.
             93          Section 5. Repealer.
             94          This bill repeals:
             95          Section 26-21a-201, Short title.
             96          Section 6. Appropriation.
             97          As an ongoing appropriation subject to future budget constraints, there is appropriated
             98      from the General Fund for fiscal year 2008-09, $2,300,000 to the Department of Health to fund
             99      subsidies for cancer screening within the Cancer Screening and Mortality Reduction Program
             100      created under Section 26-21a-301 as follows:
             101          (1) $1,500,000 for breast and cervical cancer screening; and
             102          (2) $800,000 for colorectal cancer screening.
