11 General Description:
12 This bill makes the pilot program for provision of supported employment services,
13 contained in the Services to People With Disabilities Chapter of the Utah Human
14 Services Code, into an ongoing program, subject to sunset review.
15 Highlighted Provisions:
16 This bill:
17 . establishes as an ongoing program the pilot program for provision of supported
18 employment services, subject to a sunset provision; and
19 . makes technical changes.

29 Be it enacted by the Legislature of the state of Utah:
30 Section 1. Section 62A-5-103.1 is amended to read:
31 62A-5-103.1. Program for provision of supported employment services.
32 (1) There is established a [
33 services to be administered by the division[
34
35 (2) The division shall make rules, in accordance with Title 63, Chapter 46a, Utah
36 Administrative Rulemaking Act, as necessary for the implementation and administration of
37 [
38 (3) In accordance with Subsection (4), within funds appropriated by the Legislature for
39 the [
40 services to a person with a disability who:
41 (a) is eligible to receive services from the division;
42 (b) has applied for, and is waiting to, receive services from the division;
43 (c) is not receiving other ongoing services from the division;
44 (d) is not able to receive sufficient supported employment services from other sources;
45 (e) the division determines would substantially benefit from the provision of supported
46 employment services; and
47 (f) does not require the provision of other ongoing services from the division in order
48 to substantially benefit from the provision of supported employment services.
49 (4) (a) The division shall provide supported employment services under this section
50 outside of the prioritization criteria established by the division for the receipt of other services
51 from the division.
52 (b) The division shall establish criteria to determine the priority, between persons
53 eligible for services under this section, for receiving services under this section.
54 (5) It is the intent of the Legislature that the services provided under the [
55 program described in this section:
56 (a) shall be provided separately from the Medicaid program described in Title XIX of
57 the Social Security Act;
58 (b) may not be supported with Medicaid funds;
59 (c) may not be provided as part of a Medicaid waiver;
60 (d) do not constitute an entitlement of any kind; and
61 (e) may be withdrawn from a person at any time.

73 Section 2. Section 63-55-262 is amended to read:
74 63-55-262. Repeal dates, Title 62A.
