             9      LONG TITLE
             10      General Description:
             11          This bill directs the attorney general to complete a study of all available remedies the
             12      state may have in seeking reimbursement from the federal government for costs
             13      incurred by the state resulting from illegal immigration.
             14      Highlighted Provisions:
             15          This bill:
             16          .    directs the attorney general to complete a study of all available remedies to recover
             17      any moneys owing from the federal government to the state for the reimbursement
             18      of costs incurred by the state resulting from illegal immigration; and
             19          .    directs the attorney general to file a written report with the governor, the president
             20      of the Senate, the speaker of the House of Representatives, and the chairs of the
             21      Executive Appropriations Committee that details the findings of the study.

             29      Be it enacted by the Legislature of the state of Utah:
             30          Section 1. Study of available remedies for the recovery of federal reimbursement
             31      for costs associated with illegal immigration -- Reported findings.
             32          (1) The Legislature finds that:
             33          (a) the costs incurred by the state in addressing illegal immigration have increased in
             34      recent years;
             35          (b) the areas in which these costs have been incurred include identifying illegal
             36      immigrants, processing illegal immigrants through the criminal justice system, incarcerating
             37      illegal immigrants, and providing education, medical assistance, health care, and foster care for
             38      illegal immigrants;
             39          (c) federal funding to assist states in dealing with illegal immigration has decreased;
             40      and
             41          (d) the federal government is asking state governments to use more of their own funds
             42      to enforce federal immigration laws and preserve homeland security, which are essentially
             43      federal responsibilities.
             44          (2) The attorney general shall conduct a study and review of all available state
             45      remedies to recover any moneys owing from the federal government to the state for the
             46      reimbursement of costs incurred by the state resulting from illegal immigration.
             47          (3) On or before November 1, 2008, the attorney general shall file a written report with
             48      the governor, the president of the Senate, the speaker of the House of Representatives, and the
             49      chairs of the Executive Appropriations Committee that details the findings of the review and
             50      study together with available remedies and recommendations as to how to best pursue a course
             51      of recovery of unpaid reimbursable costs related to illegal immigration.
