             8      LONG TITLE
             9      General Description:
             10          This bill creates the Radio Communications Task Force.
             11      Highlighted Provisions:
             12          This bill:
             13          .    provides for a 17 member task force, composed of legislators and others, to review
             14      and make recommendations concerning certain radio communications matters;
             15          .    addresses appointment, compensation, and staffing of the task force; and
             16          .    provides for a report from the task force to the Public Utilities and Technology
             17      Interim Committee.
             18      Monies Appropriated in this Bill:
             19          This bill appropriates:
             20          .    $6,200 to the Senate; and
             21          .    $15,000 to the House of Representatives.
             22      Other Special Clauses:
             23          This bill is repealed November 30, 2008.

             27      Be it enacted by the Legislature of the state of Utah:


             28          Section 1. Radio Communications Task Force -- Creation -- Membership --
             29      Quorum -- Compensation -- Staff.
             30          (1) There is created the Radio Communications Task Force consisting of the following
             31      17 members:
             32          (a) three members of the Senate appointed by the president of the Senate, no more than
             33      two of whom may be from the same political party;
             34          (b) seven members of the House of Representatives appointed by the speaker of the
             35      House of Representatives, no more than five of whom may be from the same political party;
             36          (c) two members representing counties, one appointed by the president of the Senate
             37      and one by the speaker of the House of Representatives from a nominee or nominees from the
             38      Utah Association of Counties, with at least one appointee being a representative of a county of
             39      the third through sixth class;
             40          (d) two members representing cities and towns, one appointed by the president of the
             41      Senate and one by the speaker of the House of Representatives from a nominee or nominees
             42      from the Utah League of Cities and Towns, with at least one appointee being a representative
             43      of a city or town in a county of the third through the sixth class;
             44          (e) one member representing participants in the current 800 MHz radio
             45      communications system appointed by the governor from among a list of nominees from the
             46      Utah Communications Agency Network board;
             47          (f) the commissioner of the Department of Public Safety; and
             48          (g) the chief information officer appointed under Section 63F-1-201 .
             49          (2) (a) The president of the Senate shall designate a member of the Senate appointed
             50      under Subsection (1)(a) as a cochair of the task force.
             51          (b) The speaker of the House of Representatives shall designate a member of the House
             52      of Representatives appointed under Subsection (1)(b) as a cochair of the task force.
             53          (3) A majority of the members of the task force constitute a quorum. The action of a
             54      majority of a quorum constitutes the action of the task force.
             55          (4) (a) Salaries and expenses of the members of the task force who are legislators shall
             56      be paid in accordance with Section 36-2-2 and Legislative Joint Rules, Title 5, Chapter 3,
             57      Expense and Mileage Reimbursement for Authorized Legislative Meetings, Special Sessions,
             58      and Veto Override Sessions.


             59          (b) A member of the task force who is not a legislator may not receive compensation
             60      for their work associated with the task force, but may receive per diem and reimbursement for
             61      travel expenses incurred as a member of the task force at the rates established by the Division
             62      of Finance under Sections 63A-3-106 and 63A-3-107 .
             63          (5) The Office of Legislative Research and General Counsel shall provide staff support
             64      to the task force.
             65          Section 2. Duties -- Interim report.
             66          (1) The task force shall review and make recommendations on the following issues:
             67          (a) methods of meeting the Federal Communications Commission's 2013 deadline for
             68      narrow band radio communications;
             69          (b) transition processes that will best serve the state and the state's political
             70      subdivisions in meeting the Federal Communications Commission's 2013 deadline; and
             71          (c) ascertaining the expected cost and appropriate revenue source to complete
             72      construction of radio communications infrastructure.
             73          (2) A final report, including any proposed legislation shall be presented to the Public
             74      Utilities and Technology Interim Committee before November 30, 2008.
             75          Section 3. Appropriation.
             76          There is appropriated from the General Fund for fiscal year 2008-09 only:
             77          (1) $6,200 to the Senate to pay for the compensation and expenses of senators on the task
             78      force; and
             79          (2) $15,000 to the House of Representatives to pay for the compensation and expenses of
             80      representatives on the task force.
             81          Section 4. Repeal date.
             82          This bill is repealed November 30, 2008.
