             9      General Description:
             10          This bill allows the Utah Education Network to provide telecommunications services
             11      for a telehealth network.
             12      Highlighted Provisions:
             13          This bill:
             14          .    allows the Utah Education Network to provide telecommunications services for a
             15      telehealth network; and
             16          .    makes technical corrections.

             25      Be it enacted by the Legislature of the state of Utah:
             26          Section 1. Section 53B-17-104 is amended to read:
             27           53B-17-104. Responsibilities of KUED - TV, KUER - FM, and UEN relating to


             28      public broadcasting and telecommunication.
             29          (1) Subject to applicable rules of the Federal Communications Commission and
             30      Section 53B-17-102 , the State Board of Regents, the State Board of Education, and the
             31      University of Utah, KUED - TV, KUER - FM, and UEN shall:
             32          (a) coordinate statewide services of public radio and television;
             33          (b) develop, maintain, and operate statewide distribution systems for:
             34          (i) KUED - TV[,];
             35          (ii) KUER - FM[, and];
             36          (iii) KUEN[,];
             37          (iv) the statewide distance learning service[,];
             38          (v) the educational data network[,];
             39          (vi) connections to the Internet[,]; and
             40          (vii) other appropriate telecommunications services [appropriate for providing];
             41          (c) provide the video, audio, and data telecommunication services described under
             42      Subsection (1)(b) in support of:
             43          (i) public and higher education[,];
             44          (ii) state government[,]; and
             45          (iii) public libraries;
             46          [(c)] (d) support the delivery of [these] the services described under Subsections (1)(b)
             47      and (c) to as many communities as may be economically and technically feasible and lawfully
             48      permissible under the various operating licenses;
             49          [(d)] (e) cooperate with state and local governmental and educational agencies and
             50      provide leadership and consulting service for telecommunication for education;
             51          [(e)] (f) represent the state with privately owned telecommunications systems to gain
             52      access to their networks for the delivery of programs and services sponsored or produced by
             53      public and higher education;
             54          [(f)] (g) acquire, produce, coordinate, and distribute a variety of programs and services
             55      of an educational, cultural, informative, and entertaining nature designed to promote the public
             56      interest and welfare of the state;
             57          [(g)] (h) coordinate with the state system of higher education to acquire, produce, and
             58      distribute broadcast and nonbroadcast college credit telecourses, teleconferences, and other


             59      instructional and training services;
             60          [(h)] (i) coordinate with the State Board of Education and school districts to acquire,
             61      produce, and distribute broadcast and nonbroadcast telecourses, teleconferences, and other
             62      instructional and training services to the public schools;
             63          [(i)] (j) act as a clearing house for the materials, courses, publications, media, software,
             64      and other applicable information related to the items addressed in Subsections (1)[(g)](h) and
             65      [(h)](i);
             66          [(j)] (k) coordinate with the State Board of Education to assist in providing the public
             67      schools of Utah with the following services:
             68          (i) broadcast, during school hours, of educational and administrative programs
             69      recommended by the State Board of Education;
             70          (ii) duplication and encoding of program masters for broadcast purposes; and
             71          (iii) program previewing;
             72          [(k)] (l) share responsibility with the State Board of Education for Instructional
             73      Television (ITV) awareness and utilization; and
             74          [(l)] (m) provide teleconference and training services for state and local governmental
             75      agencies.
             76          (2) UEN shall:
             77          (a) consult with the UEN steering committee authorized in Section 53B-17-102 and
             78      other technology coordinating committees established by the State Board of Education and
             79      State Board of Regents in acquiring, producing, and distributing instructional content;
             80          (b) coordinate the statewide development and implementation of the data network for
             81      education, which shall include video and audio, data connections, and connection to the
             82      Internet, utilizing satellite, microwave, fiber-optic, and other transmission media;
             83          (c) utilize statewide economic development criteria in the design and implementation
             84      of the educational telecommunications infrastructure; and
             85          (d) assure that public service entities such as educators, public service providers, and
             86      public broadcasters are provided access to the telecommunications infrastructures that are
             87      developed in the state.
             88          (3) UEN may provide telecommunications services for a telehealth network, as
             89      described in Section 26-9f-102 .


             90          [(3)] (4) This section neither regulates nor restricts a privately owned company in the
             91      distribution or dissemination of education programs.
