             9      General Description:
             10          This bill imposes a 25 cent fee on motor vehicle registrations or registration renewals
             11      and establishes a restricted account to fund automated license plate recognition systems.
             12      Highlighted Provisions:
             13          This bill:
             14          .    imposes a 25 cent fee on all motor vehicle registrations or registration renewals;
             15          .    allocates funds from the registration fee to purchase automated license plate
             16      recognition systems for law enforcement purposes; and
             17          .    establishes a restricted account in the Transportation Fund where revenue from the
             18      fee will be deposited.
             19      Monies Appropriated in this Bill:
             20          None
             21      Other Special Clauses:
             22          This bill takes effect on July 1, 2008.

             27      Be it enacted by the Legislature of the state of Utah:


             28          Section 1. Section 41-1a-1223 is enacted to read:
             29          41-1a-1223. Fee for license plate recognition system -- Exemption -- Fund.
             30          (1) As used in this section, "automated license plate recognition system" means a
             31      computerized camera system mounted on a vehicle or permanently mounted over a highway
             32      that recognizes license plates to alert law enforcement of violations, including:
             33          (a) amber alerts;
             34          (b) stolen vehicles;
             35          (c) stolen license plates;
             36          (d) wanted persons;
             37          (e) revoked license plates; and
             38          (f) expired license plates.
             39          (2) (a) Except as provided in Subsection (2)(b), at the time application is made for
             40      registration or renewal of registration of a motor vehicle under this chapter, the applicant shall
             41      pay an automated license plate recognition fee of 25 cents for each motor vehicle.
             42          (b) The following vehicles are exempt from the fee required under Subsection (2)(a):
             43          (i) a commercial vehicle registered as part of a fleet under Section 41-1a-222 or
             44      Section 41-1a-301 ;
             45          (ii) a motor vehicle that is exempt from the registration fee under Section 41-1a-1209
             46      or Subsection 41-1a-419 (3); and
             47          (iii) a motor vehicle with a Purple Heart special group license plate issued in
             48      accordance with Section 41-1a-421 .
             49          (3) (a) There is created within the Transportation Fund a restricted account known as
             50      the "License Plate Recognition Restricted Account."
             51          (b) The account consists of monies generated from the following revenue sources:
             52          (i) monies received by the state under Subsection (2)(a); and
             53          (ii) appropriations made to the account by the Legislature.
             54          (4) (a) The account shall earn interest.
             55          (b) All interest earned on account monies shall be deposited into the account.
             56          (5) The Motor Vehicle Enforcement Division shall use monies in the License Plate
             57      Recognition Restricted Account to:
             58          (a) purchase additional automated license plate recognition systems and equipment;


             59          (b) support and update existing automated license plate recognition systems and
             60      equipment; and
             61          (c) fund program management and personnel costs.
             62          Section 2. Effective date.
             63          This bill takes effect on July 1, 2008.
