             8      LONG TITLE
             9      General Description:
             10          This joint resolution of the Legislature proposes to amend the Utah Constitution to
             11      modify provisions relating to the compensation of members of the Legislature.
             12      Highlighted Provisions:
             13          This resolution proposes to amend the Utah Constitution to:
             14          .    require legislators to be paid an annual salary;
             15          .    prohibit members of the Legislature from receiving anything of value from a
             16      registered lobbyist, excluding campaign contributions;
             17          .    repeal obsolete language regarding temporary compensation and expenses; and
             18          .    make technical changes.
             19      Special Clauses:
             20          This resolution directs the lieutenant governor to submit this proposal to voters.
             21          This resolution provides a contingent effective date of January 1, 2009 for this proposal.

             28      Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each
             29      of the two houses voting in favor thereof:
             30          Section 1. It is proposed to amend Utah Constitution Article VI, Section 9, to read:
             31           Article VI, Section 9. [Compensation of legislators -- Citizens' salary commission
             32      -- Expenses -- Prohibition against receiving anything of value from lobbyist.]
             33          (1) Each member of the Legislature shall be paid an annual salary, the amount of which
             34      shall be determined as provided in this section.
             35          (2) The Legislature [shall] may not increase the salaries of its members on its own
             36      initiative, but shall provide by law for the appointment by the Governor of a citizens' salary
             37      commission to make recommendations concerning the salaries of members of the Legislature.
             38      Upon submission of the commission's recommendations, the Legislature shall by law accept,
             39      reject or lower the salary but may not, in any event, increase the recommendation.
             40          (3) The Legislature shall provide by law for the expenses of its members. [Until
             41      salaries and expenses enacted as authorized by this section become effective, members of the
             42      Legislature shall receive compensation of $25 per diem while actually in session, expenses of
             43      $15 per diem while actually in session, and mileage as provided by law.]
             44          (4) (a) A member of the Legislature may not, in the member's official capacity, accept
             45      anything of value from a registered lobbyist.
             46          (b) Subsection (4)(a) does not apply to a contribution to the election campaign fund of
             47      a member of the Legislature.
             48          Section 2. It is proposed to repeal Utah Constitution Article VI, Section 31:
             49           Article VI, Section 31. [Additional compensation of legislators.]
             50          [For attendance at meetings of interim committees established by law to function
             51      between legislative sessions, members of the Legislature shall receive additional per diem
             52      compensation and mileage at a rate not to exceed that provided in this Constitution for regular
             53      legislative sessions.]
             54          Section 3. Submittal to voters.
             55          The lieutenant governor is directed to submit this proposed amendment to the voters of
             56      the state at the next regular general election in the manner provided by law.
             57          Section 4. Effective date.
             58          If the amendment proposed by this joint resolution is approved by a majority of those


             59      voting on it at the next regular general election, the amendment shall take effect on January 1,
             60      2009.
