LONG TITLE
General Description:

    This bill supplements or reduces appropriations previously provided for the use and operation of state government for the fiscal year beginning July 1, 2007 and ending June 30, 2008.
Highlighted Provisions:
    This bill:
    .    provides budget increases and decreases for the use and support of certain state agencies;
    .    provides budget increases and decreases for the use and support of certain institutions of higher education;
    .    provides budget increases and decreases for other purposes as described;
    .    provides intent language.
Monies Appropriated in this Bill:
    This bill appropriates for fiscal year 2008:
    .    $56,541,700 from the General Fund;
    .    $2,401,500 from the Uniform School Fund;
    .    $2,408,500 from the Education Fund;
    .    $46,541,300 from various sources as detailed in this bill.
Other Special Clauses:
    This bill takes effect immediately.

Be it enacted by the Legislature of the state of Utah:
    Section 1. Under the terms and conditions of Section 63-38-3, the following sums of money are appropriated from resources not otherwise appropriated, or reduced from amounts previously appropriated, out of the funds or fund accounts indicated for the use and support of the government

of the State of Utah for the fiscal year beginning July 1, 2007 and ending June 30, 2008. These are additions to amounts previously appropriated for fiscal year 2008.

Expenditure of these funds is limited to: the operation of the gift shop; and $100,000 for maintenance and repairs of Capitol Hill, special upkeep of historic items, and special operational needs necessary to keep Capitol Hill functioning.

Item 11    To Department of Administrative Services - DFCM Administration
    Under terms of UCA 63-38-8.1(3), the Legislature intends not to lapse up to $500,000 provided by Item 35, Chapter 371, Laws of Utah 2007. Expenditure of these funds is limited to state building energy efficiency projects.
Item 12    To Department of Administrative Services - State Archives
    Under terms of UCA 63-38-8.1(3), the Legislature intends not to lapse up to $20,000 provided by Item 38, Chapter 1, or Item 36, Chapter 371, Laws of Utah 2007. Expenditure of these funds is limited to: Digitizing and microfilming significant historical documents generated by former Utah legislators and governors for preservation and access.
    Under terms of UCA 63-38-8.1(3), the Legislature intends

not to lapse up to $133,000 provided by Item 36, Chapter 371, Laws of Utah 2007 for regional repository projects and support grants. Expenditure of these funds is limited primarily to governmental entities to fund projects and regional repository support, but may also be used for non-governmental entities. The Legislature intends that no more than 25% of the total grants awarded for any given year be used for non-governmental entities.

    Under terms of UCA 63-38-8.1(3), the Legislature intends not to lapse Item 39, Chapter 1, or Item 37, Chapter 371, Laws of Utah 2007. Expenditure of these funds is limited to an actuarial study of post-employment benefits and the maintenance, operation, and development of statewide accounting systems.

    Under Section 63-38-8 of the Utah Code the Legislature intends that funds provided in Item 55 of Chapter 1 and Item 51 of Chapter 371, Laws of Utah 2007 for the Department of Technology Services - Integrated Technology Division shall not lapse at the close of fiscal year 2008. Expenditure of these funds is limited to: continuity of operations for the State Geographic Information Database - $125,000; and Automated Geographic Reference Center projects - $282,500.

    It is the intent of the Legislature that the State Engineer use the $30,000 in new funding provided by this item to expedite the processing of water rights and water right applications. The Legislature intends that the Division of Water Rights monitor the length of time to process an application and the State Engineer report back to the Natural Resources Appropriations

Subcommittee during the 2009 General Session.

Item 73    To Department of Transportation - Construction Management
    The Legislature intends to clarify Item 1of Chapter 6 Laws of Utah Third Special Session 2006. The Legislature intends that the portion used for corridor preservation be placed in the Transportation Corridor Preservation Revolving Loan Fund and the match portion for local governments be non-lapsing. The Legislature also intends that the match portion for local governments is intended to match funds expended on current and future state roads. The Legislature also intends that the match portion for local governments be available for a two year period from the date the local option transportation corridor preservation fee was initially imposed. Any unexpended local matching funds revert to the Transportation Corridor Preservation Revolving Loan Fund.
    The Legislature intends to clarify uses of the funding provided in item 142 of Chapter 383 Laws of Utah General Session 2007. Of the $100,000,000 one time appropriation from the General Fund $30,000,000 is to be used for corridor preservation with $16,000,000 placed in the Transportation Corridor Preservation Revolving Loan Fund and the remaining

$14,000,000 is to be used as a match for local governments. The Legislature also intends that the $14,000,000 be non-lapsing and be expended only on current and future state roads. The Legislature intends that the match portion for local governments be available for a two year period from the date the local option transportation corridor preservation fee was initially imposed. Any unexpended local matching funds revert to the Transportation Corridor Preservation Revolving Loan Fund.
