15 LONG TITLE
16 General Description:
17 This bill amends the Medical Assistance Act to require the state Medicaid program to
18 contract with ambulatory surgical centers that agree to accept certain reimbursement for
19 services.
20 Highlighted Provisions:
21 This bill:
22 . defines terms; and
23 . beginning July 1, 2008, requires the state Medicaid program to include an
24 ambulatory surgical center on its provider panel if the ambulatory surgical center
25 meets certain requirements.

34 Be it enacted by the Legislature of the state of Utah:
35 Section 1. Section 26-18-12 is enacted to read:
36 26-18-12. Ambulatory surgical centers.
37 (1) For purposes of this section "ambulatory surgical center" means an ambulatory
38 surgical facility:
39 (a) licensed under Chapter 21, Health Care Facility Licensing and Inspection Act;
40 (b) included on the state Medicaid's fee for service panel; and
41 (c) willing to accept reimbursement for Medicaid services at a rate no greater than the
42 reimbursement rates established for the services by the state Medicaid fee schedule.
43 (2) (a) By July 1, 2008, an ambulatory surgical center shall be permitted to qualify as a
44 provider eligible for reimbursement for services provided according to the state Medicaid plan.
45 (b) If the state has contracted with another entity to arrange for the provision of
46 services for persons in the state's Medicaid program, the state's Medicaid contractee:
47 (i) shall contract with an ambulatory surgical center that agrees to accept
48 reimbursement for services at the contracted rate or the Utah State Medicaid fee schedule,
49 whichever is lower; and
50 (ii) shall refer patients to all the qualified ambulatory surgical centers.
