Chair Kiser called the meeting to order at 8:10 a.m.

MOTION:    Rep. Menlove moved to approve the minutes of the February 22, 2008 meeting. The motion passed unanimously, with Rep. Herrod and Rep. Neuenschwander absent for the vote.

H.B. 146    School Bus Amendments (Rep. C. Johnson)

Rep. Johnson introduced the bill to the committee. (handout)

MOTION:    Rep. Morgan moved to delete in title and body H.B. 146 and replace it with 1st Substitute H.B. 146. The motion passed unanimously, with Rep. Neuenschwander absent for the vote.






MOTION:    Rep. Morgan moved to amend the bill as follows:

1.    Page 1, Lines 15 through 19 :    

             15          .    
{   requires   }        directs       an operator of a school bus to turn off the bus or vehicle engine upon

             16      stopping at a school;
             17          .    
{   prohibits   }        provides that       an operator of a school bus      {   from turning   }        may not:

        *     turn  
a school bus on more than five

             18      minutes before departing
  from a school;       or

        
  *            {   idling   }        idle a school bus            {   within certain locations   } for more than a      {   certain

             19      period of time  
}
  five minutes       ;      {   and   }

    
  .    provides that an operator of a school bus who violates the school bus idling standards is not subject to a criminal penalty; and      


2.    Page 8, Line 239 :    

             239      School Bus and Operators, 1999 edition.
    
  (4) A person who violates a provision of this section is not subject to a criminal penalty.      


The motion to amend passed unanimously, with Rep Neuenschwander absent for the vote.

MOTION:    Rep. Holdaway called for the question on the debate. The motion passed unanimously, with Rep. Daw, Rep. Herrod, and Rep. Menlove absent for the vote.

The substitute motion to amend failed, with Rep. Fisher and Rep. Kiser voting in favor. Rep. Daw, Rep. Herrod, and Rep. Menlove were absent for the vote.

The original motion to pass the bill out favorably passed, with Rep. Fisher and Rep. Kiser voting in opposition. Rep. Daw, Rep. Herrod, and Rep. Menlove were absent for the vote.

MOTION:    Rep. Kiser moved to adjourn the meeting. The motion passed unanimously, with Rep. Daw, Rep. Herrod, and Rep. Menlove absent for the vote.

Chair Kiser adjourned the meeting at 9:00 a.m.
