Chair VanTassell called the meeting to order at 3:35 p.m.

Approval of Minutes

    MOTION:
Sen. Walker moved to approve the minutes of the January 28, 2008 meeting.

    The motion passed unanimously with Sens. Davis, Eastman, and Niederhauser absent for the     vote.

    Sen. Walker assumed the Committee Chair.

1.    S.B. 108 Offset of Workers' Compensation and Social Security
(J. Hickman)

    Sen. Hickman introduced the bill.


    Richard Burke, Utah Association for Justice, spoke in support of the bill.

     MOTION: Sen. Mayne moved to pass the bill out favorably.

    The motion passed unanimously with Sens. Davis, Eastman, and VanTassell absent for the     vote.

2.    S.B. 134 Residential Mortgage Fraud Act (S. Killpack)

    
2nd Sub. S.B. 134 Mortgage Fraud Act was distributed.

     MOTION: Sen. Niederhauser moved to adopt 2nd Sub. S.B. 134.

    The motion passed unanimously with Sens. Davis, Eastman, and VanTassell absent for the     vote.

    Sen. Killpack introduced the bill.
            
    Chair VanTassell resumed the Committee Chair.

    Mark Steinagel, Director, Division of Real Estate, and Scott Reed, Office of the Attorney     General, answered questions from the Committee and spoke in support of the bill.

    John Norman, Executive Director, Utah Mortgage Lenders Association; Chris Sloan,     President-Elect, Utah Association of Realtors; and David Luna, President, Utah Association     of Mortgage Brokers; spoke in support of the bill.

     MOTION: Sen. Walker moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Hickman absent for the vote.

3.    S.B. 98 Licensing of Security Services (D. Eastman)

    
Sen. Eastman introduced the bill.

    Robert Anderton, security services industry, spoke in support of the bill.

     MOTION: Sen. Davis moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Hickman absent for the vote.



4.    S.B. 151 Trademark Protection Act Amendments
(D. Eastman)

    Sen. Eastman introduced the bill.

    Paul Rogers, AOL, spoke to the bill.

     MOTION: Sen. Niederhauser moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Hickman absent for the vote.

5.    S.B. 159 Workers' Compensation Amendments (D. Eastman)

    
Sen. Eastman introduced the bill and a handout was distributed.

    Dennis V. Lloyd, General Counsel, Workers' Compensation Fund, further explained the bill.

     MOTION: Sen. Mayne moved to pass the bill out favorably.

    The motion passed unanimously with Sens. Davis and Hickman absent for the vote.

6.     1st Sub. H.B. 55 Captive Insurance Company Amendments (J. Dunnigan)

    
Rep. Dunnigan introduced the bill.

    Neal Gooch, Deputy Insurance Commissioner, Utah Insurance Department, and Ted Lewis,     General Counsel, Beneficial Financial Group, spoke in support of the bill.

     MOTION: Sen. Davis moved to pass the bill out favorably.

    The motion passed unanimously with Sens. Eastman and Hickman absent for the vote.

     MOTION: Sen. Mayne moved to adjourn.

    The motion passed unanimously, with Sens. Eastman and Hickman absent for the vote.

    Chair VanTassell adjourned the meeting at 4:55 p.m.
