Chair VanTassell called the meeting to order at 4:46 p.m.
Approval of Minutes
MOTION: Sen. Hickman moved to approve the minutes of the February 25, 2008 meeting.
The motion passed unanimously with Sens. Davis, Niederhauser, and Walker absent for the vote.
1. S.B. 86 Economic Analysis and Reporting of Cost of Land Use Regulation
(M. Madsen)
Sen. Madsen explained the bill and answered questions from the Committee.
Jodi Hoffman, consultant, Utah League of Cities and Towns, spoke in opposition to the bill.
MOTION: Sen. Hickman moved to pass the bill out favorably.
The motion failed with Sens. Davis and Hickman voting in favor of the bill, Sens. Mayne, VanTassell, and Walker voting in opposition, and Sen. Niederhauser absent for the vote.
2. H.B. 401 Master Plumber Licensing (J. Dunnigan)
Rep. Dunnigan explained the bill.
David Told, Utah State Plumbing Board, and Sen. Jenkins spoke in support of the bill.
MOTION: Sen. Walker moved to pass the bill out favorably.
The motion passed unanimously with Sen. Niederhauser absent for the vote.
MOTION: Sen. Walker moved to place the bill on the Consent Calendar
The motion passed unanimously with Sen. Niederhauser absent for the vote.
3. H.B. 437 Funeral Services Licensing Act Amendments (S. Urquhart)
Rep. Urquhart explained the bill.
Shaun Myers, Executive Director, National Funeral Directors Association, spoke in support of the bill.
Rep. Urquhart proposed the following amendments:
1. Page 9, Lines 266 through 268 :
266 (4) (a) A person who removes or possesses dental gold or silver, jewelry, or mementos
267 from human remains
:
(i) with purpose to deprive another over control of the property is guilty of an offense and subject to the punishments provided in Section 76-6-412;
(ii) with purpose to exercise unauthorized control and with intent to temporarily deprive another of control over the property is guilty of an offense and subject to the punishments provided in Section 76-6-404.5; and
(iii) under circumstances not amounting to Subsection (4)(a)(i) or (ii) and
without specific written permission of the individual who has the right to
268 control those remains is guilty of a class B misdemeanor.
MOTION: Sen. Davis moved to adopt the amendments.
The motion passed unanimously with Sen. Hickman absent for the vote.
MOTION: Sen. Davis moved to pass the bill out favorably as amended.
The motion passed unanimously with Sen. Hickman absent for the vote.
MOTION: Sen. Niederhauser moved to place the bill on the Consent Calendar.
The motion passed unanimously with Sen. Hickman absent for the vote.
MOTION: Sen. Mayne moved to adjourn.
The motion passed unanimously.
