Committee Chair Buttars called the meeting to order at 8:05 a.m.

1.    S.B. 0014 Smoking Ban in Motor Vehicle (S. McCoy)     

    Sen. McCoy proposed the following amendment to the bill:


1.    Page 1, Lines 21 through 23 :    

             21      the person has enrolled in a smoking cessation program;
{   and   }

             22          .    provides that enforcement of the smoking prohibition shall be only as a secondary
             23      action
  ; and

    . provides that a violation of the smoking prohibition may not be used as a basis for or evidence of child abuse or neglect  
.


2.    Page 2, Line 49 :    

             49      person in the vehicle of Title 41, Motor Vehicles, other than this section, or for another

offense.
    

  (6) A violation of this section may not be used as a basis for or evidence of child abuse or neglect as defined in Section 62A-4a-402.      


     MOTION: Sen. Christensen moved to accept the proposed amendment.

    The motion passed with Sen. Goodfellow absent for the vote.

    Sen. McCoy explained the bill as amended.

    Michael Siler, American Cancer Society, spoke in support of the bill.

     MOTION: Sen. Christensen moved to pass the amended bill out favorably.

    The motion passed unanimously with Sen. Goodfellow absent for the vote.

2.    S.B. 050 Medical Benefits Recovery Amendments (A. Christensen)

    
Sen. Christensen presented the bill.

    Mark Brasher, Office of Recovery Services, spoke in support of the bill.

    Sandra Langley, Office of the Attorney General, gave additional information on the bill.

    Karmen Sanome, Salt Lake County Aging Services, urged the committee to look more closely at the bill before passing it out of committee. She suggested the bill go to interim study.

     MOTION: Sen. McCoy moved to pass the bill out favorably.

    The motion passed with Sen. Goodfellow voting against the bill.

3.    S.B. 101 Utah Comprehensive Health Insurance Pool Funding (G. Davis)

     MOTION: Sen. McCoy moved the following amendment to the bill:

1.    Page 4, Lines 94 through 98 :    

             94          (e) (i) For each fiscal year beginning on or after July 1,
{   2007   }        2008       , the amount of the tax

             95      collected under Subsection (1)(a) necessary to maintain the actuarial soundness of the


             96      Comprehensive Health Insurance Pool Enterprise Fund, as provided in Subsection (1)(e)(ii),
             97      shall be transferred to the Comprehensive Health Insurance Pool Enterprise Fund created under
             98      Section 31A-29-120 .
    

    The motion passed with Sen. Christensen absent for the vote.

    Sen. Davis explained the bill.

     MOTION: Sen. McCoy moved to pass the bill out favorably.

    The motion passed unanimously.    

4.    S.B. 133 Medical Assistance and Managed Care (G. Bell)

    
The bill was not heard.
