Committee Chair Peterson called the meeting to order at 2:14 p.m.

1. H.B. 249 Vehicles Covered by New Motor Vehicle Warranties (Rep. K. Gibson) (Sen. D. Peterson)

    
Rep. Kerry Gibson introduced the bill.

    MOTION: Sen. Dayton moved to pass H.B. 249, Vehicles Covered by New Motor Vehicle          Warranties, out favorably. The motion passed unanimously with Sen. Davis and Sen. Stowell absent for     the vote.

     MOTION: Sen. Dayton moved to place H. B. 249 on the Consent Calendar. The motion passed unanimously with Sen. Davis and Sen. Stowell absent for the vote.

2.    Approval of Minutes

     MOTION: Sen. Christensen moved to approve the minutes of January 30, 2008. The motion passed     unanimously with Sen. Davis and Sen. Stowell absent for the vote.

3. 1st Sub. S.B. 46 Anti-flow Control Amendments (Sen. D. Eastman)

    Sen. Dan Eastman introduced the bill.
    
     MOTION: Sen. Stowell moved to adopt the following amendment:

    




1.    Page 1, Lines 13 through 15 :    

             13          .    prohibits a public entity from requiring solid waste to be stored, recovered, or
             14      disposed of at a specific waste facility
[[   unless the public entity has physical custody

             15      of the solid waste  
]]
  except in certain circumstances       ;


2.    Page 7, Line 181 through Line 184 :                 
     181      owned or operated by a public entity if
  :

            (a)  
the solid waste is in the physical custody of:

                     182          
[[   (a)   ]]        (i)       the public entity; or

                      183          
[[   (b)   ]]        (ii)       a person with whom the public entity has an agreement to provide solid waste

                      184      management
[[   .   ]]        ; or

            (b) no other solid waste management facility exists within:
            (i) the county in which the public entity is located; or
            (ii) 25 miles outside the geographic boundary of the county described in                  Subsection (2)(b)(i).  


     The motion passed unanimously with Sen. Davis absent for the vote.

    Lincoln Shurtz, Utah League of Cities and Towns; Steve Robinson, Owner, Robinson Waste Services, and Nathan Rich, Director, Wasatch Integrated Waste Facility, spoke in opposition to the bill.

    Alan Dayton, Independent Waste Haulers Association, spoke in support of the bill.

     MOTION: Sen. Davis moved to pass 1st Sub. S.B. 46 , Anti-flow Control Amendments , out favorably, as amended. The motion passed with Sen. Waddoups voting in opposition and Sen. Stowell absent for the vote.

     MOTION: Sen. Davis moved to adjourn. The motion passed unanimously with Sen. Dayton     and Sen. Stowell absent for the vote.

    Chair Peterson adjourned the meeting at 2:55 p.m.
