Chair Niederhauser called the meeting to order at 9:20 a.m.
    
Approval of Minutes

    MOTION:
Sen. Greiner moved to approve the minutes of February 4, 2008.

    The motion passed unanimously with Sens. Goodfellow and Stephenson absent for the vote.

1.    S.J.R. 10 Joint Resolution Amending Constitution Regarding Taxes of the Elderly (G.     Davis)         
    Sen. Davis explained the bill and answered questions from the committee.

    Ronald Mortensen, Citizens Coalition for Tax Fairness; Kirt Pearson, citizen, and Allison     Rowland, Director of Research and Budget, Voices for Utah Children, expressed concerns     with the bill.




     MOTION: Sen. Dmitrich moved to pass S.J.R. 10 out of Committee with a favorable     recommendation.

    The motion passed with Sens. Dmitrich, Greiner and Waddoups voting in favor and Sen.     Niederhauser voting in opposition.

2.    H.B. 35 Motor and Special Fuel Tax Amendments (C. Frank)     
    Rep. Frank explained the bill and proposed the following amendment:

    1. Page 4, Line 92:     After "(B) has paid" remove the brackets and
        
     Lilac reinstate "the tax on"     
     MOTION: Sen. Greiner moved to adopt the amendment.

    The motion passed unaimously with Sens. Goodfellow and Stephenson absent for the vote.

    John Hill, Utah Petroleum Marketers & Retailers Association, spoke in support of the bill     and answered questions from the Committee.

     MOTION: Sen. Greiner moved to pass H.B. 35 as amended out of Committee with a     favorable recommendation.

    The motion passed unanimously with Sen. Goodfellow absent for the vote.

     MOTION: Sen. Dmitrich moved that H.B. 35 be placed on the on the Consent Calendar.

    The motion passed unanimously.

    Sen. Greiner moved to adjourn.

    The motion passed unanimously at 9:43 a.m.
