Committee Chair Walker called the meeting to order at 8:12 a.m.

Approval of Minutes

    MOTION:
Sen. Jenkins moved to approve the minutes of February 5, 2008.

    The motion passed unanimously with Sens. Killpack and Dmitrich absent for the vote.

1.     S.B. 84 Net Metering Programs (K. VanTassell)

     MOTION: Sen. VanTassell moved to adopt the following amendment:


1.    Page 3, Line 79 :    

             79          (b) for each other electrical corporation, the
  public service       commission.


2.    Page 4, Lines 102 through 113 :    

             102          [(10)] (12) "Renewable facility" means a facility that uses energy derived from [the
             103      sun, wind, or water] one of the following to generate electricity[.]:


             104          
{   (a) solar power;

             105          (b) wind power;
             106          (c) a fuel cell;
             107          (d) hydroelectric power;
             108          (e) cogeneration;
             109          (f) landfill gas;
             110          (g) digester gas;
             111          (h) dedicated energy crops available on a renewable basis; or
             112          (i) non-toxic biomass derived from solid organic fuel from wood, forest, or field
             113      residue.  
}
  (a) solar photovoltaic and solar thermal energy;

(b) wind energy;
(c) hydrogen;
(d) organic waste;
(e) hydroelectric energy;
(f) waste gas and waste heat capture or recovery;
(g) biomass and biomass byproducts, except for the combustion of wood that has been treated with chemical preservatives such as creosote, pentachlorophenol, or chromated copper arsenate;
(h) forest or rangeland woody debris from harvesting or thinning conducted to improve forest or rangeland ecological health and to reduce wildfire risk;
(i) agricultural residues;
(j) dedicated energy crops;
(k) landfill gas or biogas produced from organic matter, wastewater, anaerobic digesters, or municipal solid waste; or
(l) the combustion of wood that has been treated  



3.    Page 5, Lines 139 through 143 :    

             139          (3) (a) Notwithstanding Subsection (2)(a), the governing authority may

establish a higher amount of generating capacity from customer generation systems
             141      than .1% of the electrical corporation's peak demand during 2007 before a net metering

    The motion passed unanimously with Sen. Killpack and Sen. Dmitrich absent for the vote.

    Sen. VanTassell explained the bill.

    Mike Peterson, Utah Rural Electric Assn., spoke in support of the bill.

     MOTION: Sen. Jenkins moved to pass the bill out favorably.

     The motion passed unanimously with Sens. Killpack and Dmitrich absent for the vote.

2.    H.B. 28 Honoring Heroes Special Group License Plate (P. Ray)

    
Rep. Ray explained the bill.

     MOTION: Sen. Jenkins moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Dmitrich absent for the vote.

3.    H.B. 144 Motor Vehicle Insurance Amendments (T. Kiser)

    
Rep. Kiser explained the bill.

    Chris Purcell, State Farm Insurance, and Steve Solen, Utah Assn. of Adjusters spoke in support of the bill.




     MOTION: Sen. VanTassell moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Jenkins absent for the vote.

4.    H.B. 275 Vehicle Towing Requirements (B. Daw)

    Rep. Daw explained the bill.

     MOTION: Sen. Killpack moved to pass the bill out favorably.

    The motion passed unanimously with Sen. Jenkins absent for the vote.

MOTION: Sen. Jenkins moved to adjourn.

The motion passed unanimously.

Chair Walker adjourned the meeting at 8:30 a.m.
