             8      LONG TITLE
             9      General Description:
             10          This bill modifies provisions relating to the board of trustees of mosquito abatement
             11      districts.
             12      Highlighted Provisions:
             13          This bill:
             14          .    requires each member of a mosquito abatement district board of trustees appointed
             15      by a municipal legislative body to be a resident of the municipality; and
             16          .    provides that H. [ the member ] up to two members .H need not be a resident of the
             16a      mosquito abatement district.
             17      Monies Appropriated in this Bill:

             25      Be it enacted by the Legislature of the state of Utah:
             26          Section 1. Section 17B-2a-704 is amended to read:
             27           17B-2a-704. Mosquito abatement district board of trustees.


             28          (1) (a) (i) Notwithstanding Subsection 17B-1-302 (2) and subject to Subsection (1)(b),
             29      the legislative body of each municipality that is entirely or partly included within a mosquito
             30      abatement district shall appoint one member to the board of trustees.
             31          (ii) A member of the board of trustees appointed under Subsection (1)(a)(i):
             32          (A) shall be a resident of the municipality whose legislative body appoints the member;
             33      and
             34          (B) notwithstanding Subsection 17B-1-302 (1)(a)(ii), H. up to two members of the
             34a      board .H need not be a resident within the
             35      boundary of the mosquito abatement district.
             36          (b) If 75% or more of the area of a mosquito abatement district is within the boundaries
             37      of a single municipality:
             38          (i) the board of trustees shall consist of five members; and
             39          (ii) the legislative body of that municipality shall appoint all five members of the
             40      board.
             41          (2) The legislative body of each county in which a mosquito abatement district is
             42      located shall appoint one member to the district's board of trustees if:
             43          (a) some or all of the county's unincorporated area is included within the boundaries of
             44      the mosquito abatement district; or
             45          (b) (i) the number of municipalities that are entirely or partly included within the
             46      district is an even number less than nine; and
             47          (ii) Subsection (1)(b) does not apply.
             48          (3) If the number of board members appointed by application of Subsections (1) and
             49      (2)(a) is an even number less than nine, the legislative body of the county in which the district
             50      is located shall appoint an additional member.
             51          (4) Each board of trustees member shall be appointed as provided in Section
             52      17B-1-304 .
             53          (5) Each vacancy on a mosquito abatement district board of trustees shall be filled by
             54      the applicable appointing authority as provided in Section 17B-1-304 .
