             9      General Description:
             10          This bill amends a provision in the Wildlife Resources Code regarding the requirement
             11      to wear hunter orange.
             12      Highlighted Provisions:
             13          This bill:
             14          .    exempts a person from the requirement to wear hunter orange while using certain
             15      types of hunting permits.
             16      Monies Appropriated in this Bill:

             24      Be it enacted by the Legislature of the state of Utah:
             25          Section 1. Section 23-20-31 is amended to read:
             26           23-20-31. Requirement to wear hunter orange -- Exceptions.
             27          (1) As used in this section:
             28          (a) (i) "Centerfire rifle hunt" means a hunt for which a hunter may use a centerfire
             29      rifle, except as provided in Subsection (1)(a)(ii).


             30          (ii) "Centerfire rifle hunt" does not include:
             31          (A) a bighorn sheep hunt;
             32          (B) a mountain goat hunt;
             33          (C) a bison hunt;
             34          (D) a moose hunt;
             35          [(C)] (E) a hunt requiring the hunter to possess a statewide conservation permit; or
             36          [(D)] (F) a hunt requiring the hunter to possess a statewide sportsman permit.
             37          (b) "Statewide conservation permit" means a permit:
             38          (i) issued by the division;
             39          (ii) distributed through a nonprofit organization founded for the purpose of promoting
             40      wildlife conservation; and
             41          (iii) valid:
             42          (A) on open hunting units statewide; and
             43          (B) for the species of big game and time period designated by the Wildlife Board.
             44          (c) "Statewide sportsman permit" means a permit:
             45          (i) issued by the division through a public draw; and
             46          (ii) valid:
             47          (A) on open hunting units statewide; and
             48          (B) for the species of big game and time period designated by the Wildlife Board.
             49          (2) (a) A person shall wear a minimum of 400 square inches of hunter orange material
             50      while hunting any species of big game, except as provided in Subsection (3).
             51          (b) Hunter orange material must be worn on the head, chest, and back.
             52          [(c) A camouflage pattern in hunter orange does not meet the requirements of
             53      Subsection (2)(a).]
             54          (3) A person is not required to wear the hunter orange material described in
             55      Subsection (2):
             56          (a) during [an archery, muzzle-loader, mountain goat, or bighorn sheep hunt] the
             57      following types of hunts, unless a centerfire rifle hunt is in progress in the same area[.]:


             58          (i) archery;
             59          (ii) muzzle-loader;
             60          (iii) mountain goat;
             61          (iv) bighorn sheep;
             62          (v) bison; or
             63          (vi) moose; or
             64          (b) as provided by a rule of the Wildlife Board.
