8 LONG TITLE
9 General Description:
10 This bill modifies the Emergency Management Act by amending the membership of
11 the Emergency Management Administration Council to include members with certain
12 expertise within the private sector.
13 Highlighted Provisions:
14 This bill:
15 . specifies that up to four additional members appointed to the Emergency
16 Management Administration Council shall be members with expertise in homeland
17 security, critical infrastructure, or key resources within the private sector appointed
18 by the chair of the council;
19 . adds two representatives appointed by the Utah Emergency Management
20 Association; and
21 . makes technical changes.

31 Be it enacted by the Legislature of the state of Utah:
32 Section 1. Section 63K-3-201 is amended to read:
33 63K-3-201. Emergency Management Administration Council created -- Function
34 -- Composition -- Expenses.
35 (1) There is created the Emergency Management Administration Council to provide
36 advice and coordination for state and local government agencies on government emergency
37 prevention, mitigation, preparedness, response, and recovery actions and activities.
38 (2) The council shall meet at the call of the chair, but at least quarterly.
39 (3) The council shall be made up of the:
40 (a) lieutenant governor, or the lieutenant governor's designee;
41 (b) attorney general, or the attorney general's designee;
42 (c) heads of the following state agencies, or their designees:
43 (i) Department of Public Safety;
44 (ii) Division of Homeland Security;
45 (iii) Department of Transportation;
46 (iv) Department of Health;
47 (v) Department of Environmental Quality;
48 (vi) Department of Community and Economic Development; and
49 (vii) Department of Natural Resources;
50 (d) adjutant general of the National Guard or the adjutant general's designee;
51 (e) commissioner of agriculture and food or the commissioner's designee;
52 (f) two representatives with expertise in emergency management appointed by the
53 Utah League of Cities and Towns;
54 (g) two representatives with expertise in emergency management appointed by the
55 Utah Association of Counties; [
56 (h) up to four additional members [
57 critical infrastructure, or key resources as these terms are defined under 6 U.S. Code Section
58 101 appointed from the private sector, by the chair of the council[
59 (i) two representatives appointed by the Utah Emergency Management Association.
60 (4) The commissioner of Public Safety and the lieutenant governor shall serve as
61 co-chairs of the council.
62 (5) (a) State government officer and employee members who do not receive salary, per
63 diem, or expenses from their agency for their service may receive per diem and expenses
64 incurred in the performance of their official duties from the council at the rates established by
65 the Division of Finance under Sections 63A-3-106 and 63A-3-107 .
66 (b) State government officer and employee members may decline to receive per diem
67 and expenses for their service.
68 (6) The council shall coordinate with existing emergency management related entities
69 including:
70 (a) the Homeland Security Regional Committees established by the Department of
71 Public Safety;
72 (b) the Statewide Mutual Aid Committee established under Section 53-2-503 ; and
73 (c) the Hazardous Chemical Emergency Response Commission designated under
74 Section 63K-3-301 .
75 (7) The council may establish other committees and task forces as determined
76 necessary by the council to carry out the duties of the council.
