COUNTY FISCAL PROCEDURES AMENDMENTS

7 LONG TITLE
8 General Description:
9 This bill modifies provisions relating to county fiscal procedures.
10 Highlighted Provisions:
11 This bill:
12 . modifies a provision relating to transferring an unencumbered or unexpended
13 appropriation balance or incurring an excess expenditure to:
14 . eliminate the need for the budget officer's consent and require instead the
15 officer's review; and
16 . allow the transfer or expenditure if it is in accordance with budgetary and fiscal
17 policies or ordinances adopted by the county legislative body;
18 . modifies a provision requiring county officers to be paid monthly to allow officers
19 to be paid monthly, semi-monthly, or bi-weekly, as determined by the county
20 legislative body; and
21 . makes technical changes.

31 Be it enacted by the Legislature of the state of Utah:
32 Section 1. Section 17-16-18 is amended to read:
33 17-16-18. Salaries paid out of general fund.
34 The salaries of county officers [must] shall be paid monthly, semi-monthly, or
35 bi-weekly, as determined by the county legislative body, out of the general fund or the salary
36 fund, as the case may be, of the county upon the order of the county legislative body.
37 Section 2. Section 17-36-22 is amended to read:
38 17-36-22. Transfer of unexpended appropriation balance by department.
39 [With the consent of]
40 (1) After review by the budget officer[,] and in accordance with budgetary and fiscal
41 policies or ordinances adopted by the county legislative body, any department may:
42 (a) transfer any unencumbered or unexpended appropriation balance or any part from
43 one expenditure account to another within the department during the budget year[,]; or
44 (b) incur an excess expenditure of one or more line items [may be permitted; provided,
45 that].
46 (2) A transfer or expenditure under Subsection (1) may not occur if the transfer or
47 expenditure would cause the total of all excess expenditures or encumbrances [does not] to
48 exceed the total unused appropriation within the department at the close of the budget period.
