             8      LONG TITLE
             9      General Description:
             10          This bill modifies the Motor Vehicle Act by amending provisions relating to the penalty
             11      for false evidences of motor vehicle title and registration information.
             12      Highlighted Provisions:
             13          This bill:
             14          .    provides that it is a third degree felony, rather than a second degree felony, for
             15      providing false evidences for certain motor vehicle title or registration information.
             16      Monies Appropriated in this Bill:

             21      AMENDS:
             22          41-1a-1315, as renumbered and amended by Laws of Utah 1992, Chapter 1

             24      Be it enacted by the Legislature of the state of Utah:
             25          Section 1. Section 41-1a-1315 is amended to read:
             26           41-1a-1315. Third degree felony -- False evidences of title and registration.
             27          It is a [second] third degree felony for a person with respect to a motor vehicle, trailer,


             28      or semitrailer to:
             29          (1) fraudulently use a false or fictitious name in an application for registration, a
             30      certificate of title, or for a duplicate certificate of title;
             31          (2) knowingly make a false statement or knowingly conceal a material fact in an
             32      application under this chapter;
             33          (3) otherwise commit a fraud in an application under this chapter;
             34          (4) alter with fraudulent intent a certificate of title, registration card, license plate, or
             35      permit issued by the division;
             36          (5) forge or counterfeit a document or license plate purporting to have been issued by
             37      the division;
             38          (6) alter, falsify, or forge an assignment upon a certificate of title;
             39          (7) hold or use a document or license plate under this chapter knowing it has been
             40      altered, forged, or falsified; [and] or
             41          (8) file an application for a certificate of title providing false lien information, when the
             42      person named on the application as lienholder does not hold a valid security interest.
