             8      LONG TITLE
             9      General Description:
             10          This bill modifies the Emergency Management Act by amending the membership of the
             11      Emergency Management Administration Council to include members with certain
             12      expertise within the private sector.
             13      Highlighted Provisions:
             14          This bill:
             15          .    specifies that up to four additional members appointed to the Emergency
             16      Management Administration Council shall be members with expertise in homeland
             17      security, critical infrastructure, or key resources within the private sector appointed
             18      by the chair of the council; and
             19          .    makes technical changes.

             29      Be it enacted by the Legislature of the state of Utah:
             30          Section 1. Section 63K-3-201 is amended to read:
             31           63K-3-201. Emergency Management Administration Council created -- Function
             32      -- Composition -- Expenses.
             33          (1) There is created the Emergency Management Administration Council to provide
             34      advice and coordination for state and local government agencies on government emergency
             35      prevention, mitigation, preparedness, response, and recovery actions and activities.
             36          (2) The council shall meet at the call of the chair, but at least quarterly.
             37          (3) The council shall be made up of the:
             38          (a) lieutenant governor, or the lieutenant governor's designee;
             39          (b) attorney general, or the attorney general's designee;
             40          (c) heads of the following state agencies, or their designees:
             41          (i) Department of Public Safety;
             42          (ii) Division of Homeland Security;
             43          (iii) Department of Transportation;
             44          (iv) Department of Health;
             45          (v) Department of Environmental Quality;
             46          (vi) Department of Community and Economic Development; and
             47          (vii) Department of Natural Resources;
             48          (d) adjutant general of the National Guard or the adjutant general's designee;
             49          (e) commissioner of agriculture and food or the commissioner's designee;
             50          (f) two representatives with expertise in emergency management appointed by the Utah
             51      League of Cities and Towns;
             52          (g) two representatives with expertise in emergency management appointed by the
             53      Utah Association of Counties; and
             54          (h) up to four additional members [appointed] with expertise in homeland security,
             55      critical infrastructure, or key resources as these terms are defined under 6 U.S. Code Section
             56      101 appointed from the private sector, by the chair of the council.
             57          (4) The commissioner of Public Safety and the lieutenant governor shall serve as
             58      co-chairs of the council.


             59          (5) (a) State government officer and employee members who do not receive salary, per
             60      diem, or expenses from their agency for their service may receive per diem and expenses
             61      incurred in the performance of their official duties from the council at the rates established by
             62      the Division of Finance under Sections 63A-3-106 and 63A-3-107 .
             63          (b) State government officer and employee members may decline to receive per diem
             64      and expenses for their service.
             65          (6) The council shall coordinate with existing emergency management related entities
             66      including:
             67          (a) the Homeland Security Regional Committees established by the Department of
             68      Public Safety;
             69          (b) the Statewide Mutual Aid Committee established under Section 53-2-503 ; and
             70          (c) the Hazardous Chemical Emergency Response Commission designated under
             71      Section 63K-3-301 .
             72          (7) The council may establish other committees and task forces as determined
             73      necessary by the council to carry out the duties of the council.
