8 LONG TITLE
9 General Description:
10 This bill requires a seismic evaluation for a structure that is converted to a
11 condominium.
12 Highlighted Provisions:
13 This bill:
14 . requires a seismic evaluation for a structure that is converted to a condominium;
15 . requires the seismic evaluation to be performed:
16 . by a licensed professional structural engineer; and
17 . under a standard recognized by the International Building Code for the seismic
18 evaluation of an existing building or the seismic rehabilitation of an existing
19 building; and
20 . provides certain other requirements for the structure owner if the seismic evaluation
21 identifies an item that is not in compliance with the applicable standard.

30 Be it enacted by the Legislature of the state of Utah:
31 Section 1. Section 57-8-41 is enacted to read:
32 57-8-41. Condominium conversion -- Seismic evaluation -- Other requirements.
33 (1) If a structure is converted to a condominium in accordance with the provisions
34 under this chapter, the structure owner shall cause a seismic evaluation to be performed by a
35 person licensed under Title 58, Chapter 22, Professional Engineers and Professional Land
36 Surveyors Licensing Act, as a professional structural engineer.
37 (2) The seismic evaluation described under Subsection (1) shall be performed under a
38 standard recognized by the International Building Code for the seismic evaluation of an
39 existing building or the seismic rehabilitation of an existing building.
40 (3) If the seismic evaluation described under Subsection (1) identifies an item that is
41 not in compliance with the applicable standard, the structure owner shall, prior to occupancy of
42 the converted condominium:
43 (a) review the item of noncompliance with the appropriate county or municipality;
44 (b) correct the item of noncompliance; and
45 (c) comply with applicable county or municipality requirements, including:
46 (i) submitting the converted condominium to an inspection; and
47 (ii) obtaining an approval or a permit.
