             10      LONG TITLE
             11      General Description:
             12          This bill amends provisions related to the membership of the Utah Substance Abuse
             13      and Anti-Violence Coordinating Council.
             14      Highlighted Provisions:
             15          This bill:
             16          .    adds the director of the Division of Indian Affairs, or the director's designee, as a
             17      voting member of the Utah Substance Abuse and Anti-Violence Coordinating
             18      Council; and
             19          .    makes technical changes.

             29      Be it enacted by the Legislature of the state of Utah:
             30          Section 1. Section 63M-7-301 is amended to read:
             31           63M-7-301. Definitions -- Creation of council -- Membership -- Terms.
             32          (1) (a) As used in this part, "council" means the Utah Substance Abuse and
             33      Anti-Violence Coordinating Council, created in this section.
             34          (b) There is created within the governor's office the Utah Substance Abuse and
             35      Anti-Violence Coordinating Council.
             36          (2) The council shall be comprised of at least [25] 26 voting members as follows:
             37          (a) the attorney general or the attorney general's designee;
             38          (b) a county commissioner designated by the Utah Association of Counties;
             39          (c) the commissioner of public safety or the commissioner's designee;
             40          (d) the director of the Division of Substance Abuse and Mental Health or the director's
             41      designee;
             42          (e) the state superintendent of public instruction or the superintendent's designee;
             43          (f) the director of the Department of Health or the director's designee;
             44          (g) the executive director of the Commission on Criminal and Juvenile Justice or the
             45      executive director's designee;
             46          (h) the governor or the governor's designee;
             47          (i) the executive director of the Department of Corrections or the executive director's
             48      designee;
             49          (j) the director of the Division of Juvenile Justice Services or the director's designee;
             50          (k) the chair of the Domestic Violence Advisory Council or the chair's designee;
             51          (l) the director of the Division of Indian Affairs or the director's designee;
             52          [(l)] (m) the following members designated to serve four-year terms:
             53          (i) a member of the House of Representatives designated by the [speaker] speaker of
             54      the House of Representatives;
             55          (ii) a member of the Senate designated by the [president] president of the Senate;
             56          (iii) a member of the judiciary designated by the chief justice of the Utah Supreme


             57      Court;
             58          (iv) a representative designated by the Utah League of Cities and Towns; and
             59          (v) a representative from the offices of minority affairs designated by the directors of
             60      those offices or a designee;
             61          [(m)] (n) the following members appointed by the governor to serve four-year terms:
             62          (i) a representative of the Utah National Guard[, appointed by the governor];
             63          (ii) one resident of the state who has been personally affected by domestic violence;
             64          (iii) one resident of the state who has been personally affected by gang violence;
             65          (iv) one resident of the state who has been personally affected by alcohol or other drug
             66      abuse; and
             67          (v) one citizen representative;
             68          [(n)] (o) the following members appointed by a majority of the members described in
             69      Subsections (2)(a) through [(m)] (n) to serve four-year terms:
             70          (i) a person knowledgeable in criminal justice issues;
             71          (ii) a person knowledgeable in substance abuse treatment issues;
             72          (iii) a person knowledgeable in substance abuse prevention issues; and
             73          (iv) a person knowledgeable in judiciary issues; and
             74          [(o)] (p) in addition to the voting members described in Subsections (2)(a) through
             75      [(n)] (o), one or more chairs or co-chairs of a subcommittee established by the council
             76      appointed as a voting member by a majority of the members described in Subsections (2)(a)
             77      through [(n)] (o) [may appoint any or all of the chairs or co-chairs of a subcommittee,
             78      established by the council, as voting members of the council].
             79          (3) [No] A person, other than a person described in Subsection (2), may not be
             80      appointed as a voting member of the council.
