9 General Description:
10 This bill modifies the uses for the Public Safety Restricted Account by requiring that a
11 certain amount is appropriated annually to the state medical examiner.
12 Highlighted Provisions:
13 This bill:
14 . provides that the Legislature appropriate $100,000 annually from the Public Safety
15 Restricted Account to the state medical examiner to carry out the duties of the state
16 medical examiner; and
17 . makes technical changes.

20 Other Special Clauses:
21 This bill takes effect on July 1, 2009.

26 Be it enacted by the Legislature of the state of Utah:
27 Section 1. Section 53-3-106 is amended to read:
28 53-3-106. Disposition of revenues under this chapter -- Restricted account
29 created -- Uses as provided by appropriation -- Nonlapsing.
30 (1) There is created within the Transportation Fund a restricted account known as the
31 "Department of Public Safety Restricted Account."
32 (2) The account consists of monies generated from the following revenue sources:
33 (a) all monies received under this chapter;
34 (b) administrative fees received according to the fee schedule authorized under this
35 chapter and Section 63J-1-303 ; and
36 (c) any appropriations made to the account by the Legislature.
37 (3) (a) The account shall earn interest.
38 (b) All interest earned on account monies shall be deposited in the account.
39 (4) The expenses of the department in carrying out this chapter shall be provided for
40 by legislative appropriation from this account.
41 (5) The amount in excess of $45 of the fees collected under Subsection 53-3-105 (24)
42 shall be appropriated by the Legislature from this account to the department to implement the
43 provisions of Section 53-1-117 , except that of the amount in excess of $45, $40 shall be
44 deposited in the State Laboratory Drug Testing Account created in Section 26-1-34 .
45 (6) All monies received under Subsection 41-6a-1406 (6)(b)(ii) shall be appropriated
46 by the Legislature from this account to the department to implement the provisions of Section
47 53-1-117 .
48 (7) Beginning in fiscal year 2009-10, the Legislature shall appropriate $100,000
49 annually from the account to the state medical examiner appointed under Section 26-4-4 for
50 use in carrying out duties related to highway crash deaths under Subsection 26-4-7 (1).

53 This bill takes effect on July 1, 2009.
