Rep. Hunsaker called the meeting to order at 3:38 p.m.

MOTION:    Rep. Black moved to approve the minutes of February 2, 2009. The motion passed unanimously, with Rep. Chavez-Houck, Rep. Dunnigan, Rep. Edwards, Rep. Gibson, and Rep. Greenwood absent for the vote.

H.B. 88    Local District Board of Trustees Amendments (Rep. Janice Fisher)

Rep. Janice Fisher introduced and explained the bill to the Committee with the help of Dr. Sam Dickson, Manager of the Salt Lake Mosquito Abatement District and Ryan Lusty, Manager of the Magna Mosquito Abatement District.

MOTION:    Rep. Webb moved to amend H.B. 88 as follows:

1.    Page 1, Line 16 :    

             16          .    provides that
{   the member   }        up to two members       need not be a resident of the mosquito abatement district.


2.    Page 2, Lines 34 through 35 :    


             34          (B) notwithstanding Subsection 17B-1-302 (1)(a)(ii),
  up to two members of the board       need not be a resident within the

             35      boundary of the mosquito abatement district.

The motion passed unanimously with Rep. Chavez-Houck, Rep Dunnigan, and Rep. Gibson absent for the vote.

MOTION:    Rep. Black moved to recommend H.B. 88 favorably as amended. The motion passed unanimously, with Rep. Chavez-Houck, Rep Dunnigan, and Rep. Gibson absent for the vote.

H.B. 259    Prohibition of Impact Fees on School Districts and Charter Schools (Rep. S. Sandstrom)

Rep. Sandstrom introduced and explained the bill to the Committee.

MOTION:    Rep. Oda moved to amend H.B. 259 as follows:

1.    Page , Line 338 through Page 12, Line 338 :    

             338          (b) to authorize the imposition of an impact fee on a school district or charter school.
    
  (8) A local political subdivision or private entity may not increase the amount of an impact fee if the reason for the increase is to recoup a reduction of revenue resulting from application of Subsection (7)(b).      


The motion passed unanimously, with Rep. Chavez-Houck, Rep Dunnigan, and Rep. Gibson absent for the vote.

MOTION:    Rep. Draxler moved to recommend H.B. 259 favorably as amended.

SUBSTITUTE
MOTION:    Rep. Webb moved to hold H.B. 259 as amended. After discussion, Rep. Webb

withdrew this motion before there was a vote.

MOTION:    Rep. Dunnigan moved to adjourn the meeting. The motion failed with Rep. Black, Rep. Draxler, Rep. Fisher, Rep. Greenwood, Rep. Poulson, and Rep. Hunsaker voting in opposition to adjourn and Rep. Chavez-Houck absent for the vote.

The motion to recommend H.B. 259 favorably as amended was voted on. The motion passed with Rep. Dunnigan, Rep. Edwards, Rep. Gibson, and Rep. Webb voting in opposition and Rep. Chavez Houck absent for the vote.

MOTION:    Rep. Black moved to adjourn the meeting. The vote was unanimous. Rep. Hunsaker adjourned the meeting at 4:47 p.m.
