Vice Chair Winn called the meeting to order at 8:33 am, and called for a motion to approve the minutes of February 10, 2009.

MOTION:    Representative Wilcox moved to approve the minutes of February 10, 2009. The motion passed unanimously with Representative Gowans absent for the vote.

HR0003    Resolution on Energy Policy (Rep. M. Noel)

Representative Noel indicated that before introducing the bill he would move to delete H.R. 3 and replace it with 1st Sub. H.R. 3.

MOTION:    Representative Noel moved to delete H.R. 3 and replace it with 1st Sub. H.R. 3. The motion passed unanimously with Representative Gowans absent for the vote.

Representative Noel the introduced 1st Sub. H.R. 3, and explained its intent. He was assisted in the presentation by Randy Parker, CEO, Utah Farm Bureau, and the Governor's Council on Climate Change (BRAC) committee member.

Mike Petersen, Utah Bureau of Electric Association; Stan Rasmussen, Sutherland Institute, and Candace Daly, Nucor Corporation, spoke in favor of the bill and assisted in Representative Noel's presentation.


The following individuals spoke against the bill: Dr. Diane Nielson, Energy Advisor, State of Utah; Dr. Kelly Knutsen, Senior Policy Associate, Utah Clean Energy; Elizabeth Mitchell, Executive Director, American Institute of Architects of Utah; Kathy Van Dame, Policy Coordinator, Wasatch Clean Air Coalition; Diane Hobbins, a nurse practitioner.

MOTION:    Representative Barrus moved to pass out 1st Substitute H.R. 03 with the following amendment:

Page 1, line 8:        delete "to withdraw Utah from", and insert "not to enter into any cap and trade program proposed by"

Page 1, line 12:    delete "to withdraw Utah from", and insert "not to enter into any cap and trade program proposed by"

Page 3, line 59:    delete "to withdraw Utah from", and insert "not to enter into any cap and trade program proposed by"

SUBSTITUTE
MOTION:
    Representative Herrod moved to pass 1st Substitute H.R. 03 out favorably.

MOTION:    Representative Brown moved question on the motion. The motion passed 7-3-1 with Representatives Barrus, Chavez-Houck, and Hemingway voting in opposition to question on the motion, and Representative Gowans absent for the vote.

Voting on the substitute motion: The motion passed 7-3-1, with Representatives Barrus, Chavez- Houck, and Hemingway voting in opposition to the motion, and Representative Gowans absent for the vote.

Vice Chair Winn called for a motion to adjourn as it was time to be on the House floor.

MOTION:    Representative Brown moved to adjourn. The motion passed unanimously with Representative Gowans absent for the vote. The meeting was adjourned at 10:02 am.
