Rep. Kiser called the meeting to order at 8:40 a.m.
MOTION: Rep. Newbold moved to approve the minutes of the meetings of February 6 and 10, 2009. The motion passed unanimously with Rep. Hughes and Rep. Hutchings absent for the vote.
1st Sub. H.B. 246 Property Tax - Residential Exemption (Rep. G. Froerer)
MOTION: Rep. Froerer moved to substitute 1st Sub. H.B. 246 with 2nd Sub. H.B. 246. The motion passed unanimously with Rep. Hughes and Rep. Hutchings absent for the vote.
Rep. Froerer, accompanied by Angela Oakes, Associate General Counsel, Office of Legislative Research and General Counsel, explained 2nd Sub. H.B. 246 to the committee. Brent Gardner, Utah Association of Counties, and Lee Gardner, Salt Lake County Assessor, spoke to the bill. Nancy Lord, Bluffdale City Council, distributed a handout and spoke in favor of the bill.
MOTION: Rep. Newbold moved to transmit 2nd Sub. H.B. 246 with a favorable recommendation. The motion passed with Rep. Allen voting in opposition because the bill may have an affect on her.
Visitors from Weber State University, South Davis Libert Academy, and Paradigm High School were welcomed to the Capitol. Rep. Kiser relinquished the chair to Rep. Froerer.
H.B. 133 Earned Income Tax Credit (Rep. B. King)
Rep. King introduced the bill and explained it to the committee.
MOTION: Rep. Dougall moved to amend the bill as follows:
1. Page 2, Lines 43 through 47 :
43 (1) As used in this section, "federal earned income tax credit" means the amount of the
44 federal earned income tax credit a claimant

45 (a) in accordance with Section 32, Internal Revenue Code;
46 (b) for the taxable year; and
47 (c) on the claimant's federal individual income tax return.
The motion passed unanimously with Rep. Kiser absent for the vote.
Melissa Smith, Utah Community Action Partner Association, and Allison Rowland, Voices For Utah Children, spoke in favor of the bill. Royce Van Tassell, Utah Taxpayers Association, spoke against the bill.
MOTION: Rep. Hutchings moved to transmit H.B. 133 as amended with a favorable recommendation. The motion passed with Rep. Newbold and Rep. Sandstrom voting in opposition and Rep. Allen and Rep. Dougall absent for the vote.
MOTION: Rep. Harper moved to adjourn. The motion passed unanimously with Rep. Allen and Rep. Dougall absent for the vote.
Rep. Froerer adjourned the meeting at 9:51 a.m.
