Chair Bramble called the meeting to order at 8:12 a.m.
MOTION: Sen. Morgan moved to approve the minutes of the February 25, 2009 meeting.
The motion passed unanimously with Sen. Jenkins absent for the vote.
1. 1st Sub. H.B. 150 -- State Board of Education Member Election Process Amendments
Rep. Moss introduced and explained the bill.
Mark Cluff, Former Member, State Board of Education; Steven Whitehouse, Citizen; Marilyn Gillette, Tooele County Clerk, County Clerks Association; Tom Bingham, President, Utah Manufacturers Association; and Jim Olsen, President, Utah Food Industry Association; spoke against the bill.
Christine Kearl, Governor's Office, Carol Murphy, State Board of Education District 12; JoDee Sundberg, Alpine School Board Member, Utah School Boards Association; Cheryl Phipps, Legislative Vice President, Utah PTA; Steven H. Peterson, Executive Director, Utah School Boards Association; and John Pingree, Former State Board of Education Member; spoke in favor of the bill.
MOTION: Sen. Morgan moved to pass 1st. Sub. H.B. 150 out of committee with a favorable recommendation.
The motion failed with Sens. Goodfellow and Morgan voting in favor, and Sens. Bramble, Dayton, Hillyard, Jenkins, and Stephenson voting in opposition.
2. S.B. 241 -- Instructional Expenses Requirement
Sen. Madsen introduced and explained the bill.
Todd Hauber, Associate Superintendent, Utah State Office of Education, spoke to the bill.
MOTION: Sen. Hillyard moved to adopt the following amendment:
1. Page 1, Line 17 :
17 Education;

and
}
. provides an exemption for small school districts; and
2. Page 2, Line 50 :
50 of receiving the request.
(4) The provisions under this section do not apply to a school district with an
enrollment of less than 5,000 students.
The motion passed unanimously.

The motion passed unanimously with Sen. Morgan absent for the vote.
