Committee Chair Stowell called the meeting to order at 4:28 p.m.
1. S.B. 80 Fire Liability Modifications (Sen. M. Dayton)
Sen. Dayton introduced the bill. Dick Buehler, Director, Division of Forestry, Fire and State Lands, and Mike Johnson, Assistant Attorney General, Department of Natural Resources, assisted in the presentation.
Robin Riggs, Vice President, Salt Lake Chamber of Commerce, and Jeff Devashrayee, General Director of Ethics and Compliance, Union Pacific Railroad, spoke in opposition to the bill.
MOTION: Sen. Davis moved to replace S.B. 80 with 1st Sub. S.B. 80, Fire Liability Modifications.
The motion passed with Sen. Dayton and Sen. Stowell voting in opposition.
MOTION: Sen. Dayton moved to pass 1st Sub. S.B. 80, Fire Liability Modifications, out of committee with a favorable recommendation.
The motion passed unanimously.
Sen. Davis requested that 1st Sub. S.B. 80 be place on Interim Committee study.
2. H.C.R. 6 Concurrent Resolution Expressing Opposition to Congressional Efforts to Expand the Jurisdiction of the Clean Water Act (Rep. M. Brown) (Sen. R. Okerlund)
Rep. Brown introduced the bill.
Mark Walsh, Executive Director Western Counties Alliance; Mike Kohler, Executive Director, Daily Producers of Utah; and Jeff Hartley, REDF, spoke in support of the bill.
MOTION: Sen. Christensen moved to pass H.C.R. 6, Concurrent Resolution Expressing Opposition to Congressional Efforts to Expand the Jurisdiction of the Clean Water Act, out of committee with a favorable recommendation.
The motion passed unanimously with Sen. Davis and Sen. Dayton absent for the vote.
MOTION: Sen. Christensen moved to have H.C.R. 6 placed on the Consent Calendar.

3. H.C.R. 5 Concurrent Resolution Urging the Realignment of Air Quality Non-
attainment Designations by the EPA (Rep. R. Menlove) (Sen. P. Knudson)
Rep. Menlove introduced the bill. Cheryl Heying, Director, Utah Division of Air Quality, assisted in the presentation.
Tom Bingham, President, Utah Manufacturers Association, spoke in support of the bill.
MOTION: Sen. Christensen moved to replace H.C.R. 5 with 1st Sub. H.C.R. 5,Concurrent Resolution Urging the Realignment of Air Quality Non-attainment Designations by the EPA.
The motion passed unanimously with Sen. Davis and Sen. Dayton absent for the vote.
MOTION: Sen. Christensen moved to pass 1st Sub. H.C.R. 5, Concurrent Resolution Urging the Realignment of Air Quality Non-attainment Designations by the EPA, out of committee with a favorable recommendation.
The motion passed unanimously with Sen. Davis and Sen. Dayton absent for the vote.
