LONG TITLE
General Description:

    This bill supplements or reduces appropriations previously provided for the use and operation of state government for the fiscal years beginning July 1, 2008 and ending June 30, 2009 and beginning July 1, 2009 and ending June 30, 2010.
Highlighted Provisions:
    This bill:
    .    provides appropriations for the use and support of certain state agencies;
    .    provides appropriations for the use and support of public education;
    .    provides budget increases and decreases for other purposes as described; and
    .    provides intent language.
Monies Appropriated in this Bill:
    This bill appropriates for fiscal year 2009 effective July 1, 2010:
    .    $80,995,500 from the Uniform School Fund;
    .    ($91,200,000) from various sources as detailed in this bill.
    This bill appropriates for fiscal year 2009 effective immediately:
    .    $45,000,000 as a transfer from the General Fund to the Education Fund;
    .    ($80,995,500) from the Uniform School Fund;
    .    ($126,534,300) as a transfer from the Education Fund to the Uniform School Fund;
    .    $116,700,000 from various sources as detailed in this bill.
    This bill appropriates for fiscal year 2010:
    .    $4,555,000 from the General Fund;
    .    $2,261,403,400 as a transfer from the Education Fund to the Uniform School Fund;
    .    $3,133,700 from various sources as detailed in this bill.
Other Special Clauses:


    Sections 1 and 3 of this bill take effect on July 1, 2009. Section 2 of this bill takes effect immediately.

Be it enacted by the Legislature of the state of Utah:
    Section 1. Under the terms and conditions of Title 63J, the following sums of money are appropriated from resources not otherwise appropriated, or reduced from amounts previously appropriated, out of the funds or fund accounts indicated for the use and support of the government of the State of Utah for the fiscal year beginning July 1, 2008 and ending June 30, 2009. These appropriations net against amounts previously appropriated for fiscal year 2009 effective July 1, 2009 in uncodified Section 15, One-time appropriations for fiscal year 2008-09, Chapter 391, Laws of Utah 2009, whereby negating those appropriations.

    Section 2.     The Legislature intends that the Division of Finance, after accounting for revenue collections that accrue directly to the Uniform School Fund in fiscal year 2009, shall transfer from the Education Fund to the Uniform School Fund an amount sufficient to cover fiscal year 2009 Uniform School Fund appropriations but not to exceed the sum of transfers between the Education and Uniform School Funds contained in all appropriations acts for fiscal year 2009.

    The Legislature intends that the Division of Finance transfer up to $45,000,000 from the General Fund to the Education Fund in fiscal year 2009 to balance revenue and expenditures in both funds. The Division of Finance shall transfer only as much from the General Fund to the Education Fund as necessary to cover Education Fund appropriations in fiscal year 2009, but shall not transfer an amount sufficient to cause a year end deficit in the General Fund.
